2 Archery: October 1 January 17, 2016 Cook, DuPage, Lake and por ons of Kane County east of State Route 47 are open for the full archery season. For all other coun es and that por on of Kane County west of State Route 47, the archery deer season is October 1 January 17 EXCEPT that archery deer hun ng is closed for the two firearm seasons. Archery deer hun ng is open during the muzzleloader only season (December 11 13), the Youth Firearm season (October 10 12) and the Late Winter Firearm/Special CWD seasons (December 31, 2015 January 3, 2016 & January 15 17, 2016).

3 For the purposes of establishing eligibility for property only hun ng permits, the Department shall, a er determining the total acreage of the applicable tract or tracts of land, round remaining frac onal por ons of an acre greater than or equal to half of an acre up to the next whole acre [520 ILCS 5 ]. If the property is owned or rented by more than one person, only one landowner (and his immediate family) or one tenant (and his immediate family) will be issued permits for every 40 acres of owned or rented land. For example, if three persons own 90 acres, only two of the landowners and their immediate families may receive permits.

4 Members of the immediate family (limited to the spouse, children or parents permanently residing on the same property as the landowner or tenant) are eligible to apply for property only hun ng permits. A hun ng rights lease or other non agricultural lease is not valid for a property only hun ng permit. Proof of land ownership for ALL applica ons must be provided by submi ng a copy (ORIGINALS WILL NOT BE RETURNED) of one of the following: A) recorded property deed; B) recorded contract for deed; C) Most recent real estate tax statement for property (upon which the landowners name and acreage appears); D) current Farm Service Agency 156 EZ form.

5 A Resident Landowner is one who owns 40 acres or more of land and may apply for landowner permits to hunt the owned, leased or rented property ONLY. A Tenant is one who rents 40 acres or more of land for commercial agricultural purposes under an agreement with a landowner. Commercial agriculture shall be defined as u liza on of land for the raising of hay, grain crops or livestock for profit. Corpora on applicants must submit a copy of ownership interest in a for profit corpora on with a fully executed stock cer ficate, ar cles of incorpora on or corporate agreement.

6 Bona fide equity shareholder means an individual who: A) purchased, for market price, publicly sold stock shares in a corpora on; purchased shares of a privately held corpora on for a value equal to the percentage of the appraised value of the corporate assets represented by the ownership in the corpora on; or is a member of a closely held family owned corpora on and has purchased or been gi ed with shares of stock in the corpora on accurately reflec ng his or her percentage of ownership; B) Intends to retain the ownership of the shares of stock for at least 5 years. Limited Liability Company applicants must submit a copy of the LLCs ar cles of organiza on or the opera ng agreement iden fying the applicant as a bona fide equity member.

7 Bona fide equity member means an individual who: A) Became a member upon the forma on of the LLC; or has purchased a distribu onal interest in an Illinois limited liability company for a value equal to the percentage of the appraised value of the LLC assets represented by the distribu onal interest in the LLC and subsequently becomes a member of the company pursuant to Ar cle 30 of the Limited Liability Company Act; and B) Intends to retain the membership for at least 5 years; C) Members of Foreign LLCs must include the latest, file stamped, filing with the Illinois Secretary of State as part of the applica on for a permit.

8 Limited partnerships, limited liability limited partners, and limited liability partnership applicants must submit a copy of the agreement, cer ficate of partnership or statement of qualifica on: Bona fide equity partner means an individual who: A) Became partner, either general or limited, upon the forma on of the part nership; or has purchased a distribu onal interest in the partnership or limited partnership for a value equal to the percentage of the appraised value of the partnership assets represented by the distribu onal interest in the partnership; B) Intends to retain ownership of the partnership for at least 5 years.

9 General partnership applicants must submit a copy of the partnership agreement. Trust applicants must submit a copy of a trust agreement, which must indicate that the trust owns at least 40 acres and the applicant is listed by name as a current income beneficiary of the trust. Bona fide current income beneficiary means an individual who at the me of applica on for a permit, is en tled to income (whether income exists or not) from the trust which owns the land the applicant wishes to hunt with no condi on precedent (such as surviving another person, reaching a certain age, etc.)

10 The tenant is required to submit, in addi on to proof of ownership: A) A lease or rental agreement, file stamped as recorded by the county clerk, covering the current year. B) A copy of a current Farm Service Agency 156 EZ form. Shareholders of corpora ons/members of LLCs/trusts/partners of partnerships Bona fide equity shareholders of corpora ons, bona fide equity members of LLCs, bona fide current income beneficiaries of trusts or bona fide partners of partnerships owning 40 or more acres of land in a county may apply for one permit to hunt the corpora on, LLC, trust or partnership lands only.
