Statement of Mickey Blashfield, Director of Governmental Relations, regarding the 6th Circuit Ct. of Appeals Ruling: We respectfully disagree with the Court of Appeals decision. The FHWA refused to consider the Ambassador Bridge Twin Span even though it was the highest ranked alternative in most of the environmental tests the FHWA was required to apply. The FHWA supposedly based its decision on the unsupported claim that Canada objected to the environmental impacts the Twin Span would have in Canada, despite no evidence of any such impact. To the contrary, in February of this year Canada issued an Environmental Assessment for the Ambassador Bridge Twin Span which concluded that it is not likely to cause significant adverse environmental effects'.
2 We will determine the best way to proceed and correct these unlawful errors in FHWA's NEPA process.
