3 [ ] 27-289 Standards. - The provisions ofreference standard RS-4 shall be a part of this SUBCHAPTER . [ ] 27-290 Definitions. - For definitions tobe used in the interpretation of this SUBCHAPTER , seesubchapter two of this chapter.*ARTICLE 2 BUILDING ACCESSSUBARTICLE 1 FIRE DEPARTMENT ACCESS [ ] 27-291 Frontage. - Every building,exclusive of accessory buildings, shall have at leasteight per cent of the total perimeter of the buildingfronting directly upon a street or frontage space. For thepurposes of this section, building perimeter shall bemeasured at that story having the maximum enclosedfloor area. [ ] 27-292 Building access. - Provisionsshall be made for access by the fire department to everybuilding as follows:(a) Above grade. - Access shall be provided directlyfrom the outdoors to each story below a height of onehundred feet except to the first story or ground floor, byat least one window or readily identifiable access panelwithin each fifty feet or fraction thereof of horizontallength of every wall that fronts on a street or frontagespace.

4 Windows shall be openable or breakable fromboth the inside and the Outside , and shall have a sizewhen open of at least twenty-four inches by thirty-sixinches. Panels shall be openable from both the insideand Outside and shall have a height when open of forty-eight inches and a width of at least thirty-two sill of the window or panel shall not be higher thanthirty-six inches above the inside floor.(b) Below grade. - Access shall be provided directlyfrom the outdoors to the first basement or cellar storybelow grade, except as provided in paragraphs two,three and four of this subdivision, within each onehundred feet or fraction thereof of horizontal length ofevery wall that fronts on a street or frontage access shall be by stairs, doors, windows or othermeans that provide an opening forty-eight inches highand thirty-two inches wide, the sill of which shall notbe higher than thirty-six inches above the inside an areaway is used to provide below grade access, theminimum horizontal dimension shall be at least one-third the depth of the areaway or six feet whichever isless.

5 (1) Access to additional stories below grade is notmandatory since they are required to be sprinklered asprovided in subdivision k of section 27-954 of articlefour of SUBCHAPTER seventeen of this chapter.(2) One- and two-family dwellings need not providedirect access.(3) Any building classified in occupancy group J-2 notmore than three stories in height and with not more thantwo dwelling units on any story need not provide directaccess when such first basement or cellar story is usedfor dwelling units or for uses accessory to theresidential use in the building.(4) Except as provided in paragraph three of thissubdivision, for buildings classified in occupancy groupJ-1 or J-2 only one direct access from the outdoors tothe first basement or cellar story consisting of a stair ordoor shall be required when such story is used fordwelling units or for uses accessory to the residentialuse in the building.

6 (c) Signs. - Where wall signs are erected to cover doorsor windows of existing buildings, access panels shall beprovided as necessary to comply with the requirementsof subdivisions (a) and (b) of this section.(d) Location. - Wherever practicable, one accessopening in each story shall provide access to a stairway,or where there is no stairway at the exterior wall, oneaccess opening in each story shall be located as close aspracticable to a stairway.(e) Exemptions. - The provisions of subdivisions (a)through (d) of this section shall not apply to any storythat is completely protected by an automatic sprinklersystem conforming to the construction requirements ofsubchapter seventeen.*Local Law 58-1987.*SUBARTICLE 2 FACILITIES FOR PEOPLEHAVING PHYSICAL DISABILITIES Scope. - As set forth in this subarticle,buildings shall be provided with accessible routes,usable or adaptable space and accessible elements andfacilities to make buildings accessible and usable by,and to establish a safe environment for, all categories ofpeople having physical disabilities.

7 Standards. - The pertinent provisions ofreference standard RS 4-6 shall be part of this subarticle. Definitions. - For definitions to be used inTitle 27 / SUBCHAPTER 4125the interpretation of this subarticle, see section 27-232and reference standard RS 4-6. General Requirements. -(a) This subarticle shall apply to all buildings orportions thereof and their accessory areas, except asspecified in this subarticle.(b) The provisions of this subarticle shall be supplementalto and take precedence over less restrictive provisionsof this code in the following articles and sections and intheir referenced national standards:(1) SUBCHAPTER four, building limitationsa. 27-308 ramps(2) SUBCHAPTER six, means of egressa. 27-357 (d) building accessb. 27-371 (e) door opening widthc. 27-377 ramps(3) SUBCHAPTER seven, special uses and occupanciesa. Article ten, public garagesb. Article eleven, open parking structuresc.

8 Article thirteen, open parking lotsd. Article fifteen, swimming pools(4) SUBCHAPTER eight, places of assemblya. 27-531 Seating in assembly spaces(5) SUBCHAPTER sixteen, plumbing and gas pipinga. Reference standard RS-16, paragraph (d) of accessibility(6) SUBCHAPTER seventeen, fire alarm, detection andextinguishing equipmentc. Article six, smoke detecting devices(7) SUBCHAPTER eighteen, elevators and conveyorsa. Reference standard RS 18-1(c) Facilities in existence on the effective date of thissubarticle which comply with the requirements of thissubarticle or of other provisions of this code relating tothe provision of facilities for people with physicaldisabilities shall not be diminished to less than thosewhich would be required were the building in which thefacilities are located hereafter erected. Accessibility. -(a) Primary entrance(s).

9 - The primary entrance(s) forbuildings shall be accessible, except for buildingsclassified in occupancy group A, J-3 and/or otherspaces which normally are not frequented by the publicor employees of the facility.(b) Exterior accessible route. - Except as provided inthis subarticle, buildings shall be provided with anexterior accessible route to permit entry at the primaryentrance(s) of the building from the following locations:(1) Public street or sidewalk(2) Driveways(3) Parking areas(4) Passenger loading zones(5) Transportation stops(c) Interior accessible route. - Except as provided inthis subarticle, in buildings having (an) interior route(s)to one or more of the following spaces or facilities,such route(s) shall be (an) interior accessible route(s)from the entrance(s) usable by all categories of peoplehaving physical disabilities to adaptable or usabledwelling units and other spaces and facilities on thesame premises including but not limited to:(1) Laundry rooms(2) Refuse disposal locations(3) Mailbox areas(4) Recreational, assembly and tenants' meeting rooms(5) Storage rooms(6) Management offices(7) Stores(8) Dining areas(9) Parking areasWhere the only route to one or more of such spaces orfacilities is an exterior route, such route shall beaccessible.

10 (d) Path of travel. - The path of travel in exterior andinterior accessible routes shall provide unobstructed safeaccess and applicable items in such path of travel shallcomply with the requirements set forth in referencestandard RS 4-6.(e) Elevators. - Where provided, all elevators shallcomply with SUBCHAPTER eighteen, reference standardRS 18-1, where an interior accessible route is required.(f) Assembly occupancies. - For assembly occupancieshaving a mezzanine or balcony which provides asimilar view as that from the main floor, accessibility tothe mezzanine or balcony shall not be required providedtoilet rooms are on the main floor.(g) Restaurants. - For restaurants, dining rooms andsimilar occupancies having the same services on levelsother than the main floor, accessibility to such levelsshall not be required provided that toilet rooms are onthe main floor.(h) Storage. - For buildings in which the intended useis the storage of goods or merchandise, the onlyrequirement shall be accessibility at the primaryentrance and an interior accessible route to officeswhere business may be conducted.
