9 Discharges in the United States are regulated underthe National Pollutant Discharge Elimination System (NPDES)Program, which is part of the Clean Water Act. Several types ofactivities considered highly polluting of stormwater are regulated,including specific industrial activities. Since the mid-1990s in Arizonaand elsewhere in the United States, stormwater discharges fromregulated industry facilities have been permitted by way of a multi - sector general Permit (MSGP). In general , the MSGP is based onthe premise that permitted facilities can prevent contamination ofstormwater and consequently prevent degradation of the water qualityof receiving streams by implementing and monitoring onsite structuraland non-structural stormwater pollution prevention best managementpractices (BMPs).The EPA (federal) MSGP is one large permit that regulatesnumerous separate sectors. Each sector represents a different type ofactivity and makes use of standard industrial classification (SIC) codesor narrative descriptions to identify the industries that require permitcoverage.

10 Since before Arizona received primacy over the NPDESP rogram in late 2002, regulated industrial facilities in our State havebeen authorized to discharge stormwater under the federal MSGP-2000 (65 FR 64746). This permit was issued on October 30, 2000,and was subsequently adopted by ADEQ to apply in Arizona until anew Arizona-specific industrial stormwater permit became all general permits, the MSGP-2000 expired five yearslater on October 30, 2005. In absence of a new permit to replace it,the MSGP-2000 was administratively continued for facilities thatwere covered under the permit at the time it expired. The shortcomingwas that until a new permit became available, new regulated industrialfacilities would not be able to obtain permit coverage. Nonetheless,ADEQ has expected that operators of new regulated industrialfacilities in Arizona to develop stormwater pollution prevention plans(SWPPPs), implement BMPs, and follow the appropriate sector -specific requirements as described in the MSGP-2000.
