If you receive a Pension from the Teesside Pension fund , and you start work for any employer who is a member of the Local Government Pension Scheme (LGPS), you may be able to continue to receive your Pension despite being paid by your new employer.

It is the policy of the Teesside Pension fund to re-assess retirement benefits if a member becomes re-employed by any Local Government Pension Scheme Employer only where the Pension was enhanced due to the award of Compensa-tory Added Years or due to ill health. IMPORTANT You should be aware that certain employers may have entered into an Admission Agreement with an administering authority to participate in the benefits provided by the Local Government Pension Scheme and if you enter such employment your Pension may be liable to reduction or suspension as though your employer were a Local Government Pension Scheme Employer . It is essential therefore that you inform Teesside Pension fund immediately of any proposed employment if you received an ill health Pension or have been awarded Compensatory Added Years. What am I required to do? If you have been awarded an ill health Pension from a former employment with TPF, you should tell us about any new job as soon as you take it.

If you don t we may overpay your Pension and you would then have to pay the money back to us. You are required by law to:- Let your employer know that you are receiving a Local Government Retirement Pension , and Write to the Teesside Pension fund and inform us that you have taken up new employment with an employer who participates in the LGPS You must tell us the name and address of your new employer, your rate of pay and, if you are a member of your new employer s Pension scheme, the name of that scheme. We will then be able to tell you if, and how, your Pension will be affected. Any suspension to an ill health Pension will only apply whilst you remain in that job. IF YOU ARE CONSIDERING RE-EMPLOYMENT WITH A LOCAL GOVERNMENT EMPLOYER AND YOU HAVE A Pension FROM A SOURCE OTHER THAN THE Teesside Pension fund , YOU SHOULD INFORM YOUR PREVIOUS ADMINISTRATORS AS THEIR POLICIES MAY BE DIFFERENT. What if I retired early with Compensatory Added Years (CAY)?

If you were awarded compensatory added years when you retired, starting a new job could result in your Pension being reduced on a permanent basis, even if you only go back to work for a short time. Regulations state that you are not allowed to be better off than you would have been in your previous job. This generally means that if your new pay plus your Pension (including annual compensation) is more than your old pay, your annual compensation will be reduced by the difference. If the difference is bigger than your annual compensation, the compensation will be stopped. When you leave your new employment we will review you eligibility to Added Years. If your added years, combined with the period of time in your new job is more than the service you could have accrued from your first retirement date to age 65, the added years part of your Pension will be reduced permanently. If you work part-time, we will convert the actual period of time in your new job to its whole time equivalent length.

Example:- Years Membership in former employment 20 Compensatory Added Years awarded 10 Period of new employment 8 Total Years 38 Membership accrued if you had continued to work in your old job until age 65 35 Number of years taken from your Pension 3 In other words the compensation that was originally awarded would be re-calculated by reducing the Compensatory Added Years from 10 to 7.
