5 APPLIES TO ALL FELONIES AND SOME MISDEMEANORS. MANDATORY ACCEPTANCE BY RECEIVING STATE (ICAOS RULE ) An offender is eligible for transfer and it is mandatory that the receiving state accepts him if: He has 90 days or more remaining on supervision at the time the sending state transmits the transfer request AND He has a valid plan of supervision; AND He is in substantial compliance with the terms of supervision in the sending state; AND He is a resident of the receiving state; OR 4 He has resident family in the receiving state who are willing and able to assist the offender.

8 IMPORTANT INFORMATION FOR SUBMITTING A TRANSFER REQUEST 1. You must only use forms approved and supplied by the INTERSTATE Commission for Adult Offender Supervision (Rule ) (available at ). 2. Whether seeking mandatory or discretionary transfer of an offender, use the same two forms Transfer Request, and Offender Application for INTERSTATE COMPACT Transfer, THE OFFENDER APPLICATION FOR INTERSTATE COMPACT TRANSFER MUST BE SIGNED BY THE OFFENDER AND WITNESSED. 3. You must keep the original offender-signed document in your files. The information that the Transfer Request form asks for is the information that the rule requires.

9 That is, if you fill out this form completely and attach the documentation listed on the 2d page under Attachments, you have complied with your obligation to provide offender information. 4. It is very important that you review the Offender Application for INTERSTATE COMPACT Transfer form with the offender and be sure he or she understands it before he or she signs it. Please take a moment to review it for yourself to see why it is so important. One reason the application is important is because by signing the form, the offender waives extradition. 5 5. You must verify the proposed residence and the proposed employment1.

10 Call the sponsor and/or employer and list the date of the contact on the Transfer Request form. 6. All required documents must be attached and the documents checked for accuracy and completeness. The TEXAS INTERSTATE COMPACT Office will not forward transfer packets to the receiving state until a complete transfer packet is received. 7. An offender seeking to relocate MAY NEVER travel to a receiving state without reporting instructions (RI) issued by the receiving state or an acceptance with one exception. The offender should not be issued a travel permit after a transfer request has been made.
