Commission Resolution Acknowledgement of bexar county Judge Nelson Wolff and his over 50 years of public service to improving Transportation in Texas . 4. Contracts Consider the award or rejection of contracts for highway construction and maintenance, and construction and rehabilitation of buildings (Presentation) These proposed minute orders contain information concerning the receipt of bids for highway improvement contracts. The department may reschedule receipt of bids for those projects where the Commission rejects all bids. Those bids accepted by the Commission will result in conditional contract awards to the low bidders. Con tract a ward co n dition s ma y involve securin g fu nding fro m o ther so urces, th e co ntractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal.

The purpose of this p resentation is to f a ci li ta te a discussion of the 2 02 3 UTP planning targets and investment strategy. The outcome will be a guidance document to be distributed to department districts, metro politan p lann ing o rgan ization s, a nd o th er p lann ing p artners fo r th e d evelopment o f the 2023 UTP. 7. Montgomery county - city of Magnolia - Consider final approval of a request from the city of Magnolia for a State Infrastructure Bank loan in the amount of up to $2,803,158 to pay for a contribution to the department to pay for the costs of utility relocation necessary for a non-tolled state highway improvement project to widen FM 1488 in Montgomery county , Texas (MO) (Map) city of Magnolia ( city ) will secure the loan with a pledge of utility revenues. Minute Order Reconsideration 116186 bexar county - SL 368 - Consider rescinding Minute Order 114170, dated December 18, 2014, and rescinding those portions of Minute Order 114219, dated February 26, 2015, which amended Minute Order 114170 (MO) Under Minute Order 114170, as amended by Minute Order 114219, the Commission recommended that a portion of Loop 368 (Tract 1) be removed from the state highway system and transferred to th e city o f S an antonio su bj ec t to its continued use for public ro ad purposes. The removal from the system and the transfer to the Cit y of San An ton io were to occur upon issua nce of the Pro je ct Acceptance Letter for p roje ct CSJ 0016-08 -034.

8 No such Project Acceptance Letter has been issued. The Commission is to consider a d etermina tion th at Tract 1 continues to be needed for st a te h ighwa y p u rposes. 10. Eminent Domain Proceedings 116187 Various Counties - Consider the authorization of the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see attached itemized list) (MO) Co mmissio n findings, d etermination s, a n d a uthoriza tio ns fo r the sta te, by motion made in accordance with Senate Bill 18, 82nd Legislature, to acquire by eminent domain, upon the payment of adequate and just co mp en sation, va rious o wnersh ip interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the a ttached itemized list.

Donations to the Department Various Districts - Consider the acknowledgment of donations with a value of $500 or more, including donations of money, materials, services, or real property, that are made to the department for the purpose of assisting the department in carrying out its functions and duties or for improving access to or from a highway on the state highway system (see attached itemized list) (MO) State statutes require the Commission to acknowledge the acceptance of a gift to the department that is valued at $500 or more. By the adoption of this minute order, the Commission acknowledges the receipt and a cceptance of the property specified in the mi n ute o rder.
