4 History. , Thepurposeofthischapteris:(1)Togivestatu toryrecognitionto thecondominiumformofownershipofrealprope rty.(2)Toestablishproceduresforthecreati on,sale, , Asusedin thischapter,theterm:(1) Assessment meansa shareof thefundswhicharerequiredforthepaymentofc ommonexpenses, (2) Association means,inadditiontoanyentityresponsiblefo rtheoperationofcommonelementsownedinundi videdsharesbyunitowners,anyentitywhichop eratesor maintainsotherrealpropertyin whichunitownershaveuserights,wheremember shipin theentityis composedexclusivelyofunitownersortheirel ectedorappointedrepresentativesandis a requiredconditionofunitownership.(3) Associationproperty meansthatproperty,realandpersonal,whichi sownedorleasedby,orisdedicatedbya recordedplatto,theassociationfortheusean dbenefitofitsmembers.

5 (4) Boardofadministration or board meanstheboardof directorsorotherrepresentativebodywhichi sresponsibleforadministrationoftheassoci ation.(5) Buyer purchaser maybeusedinterchangeablywiththeterm buyer. (6) Bylaws meansthebylawsof theassociationastheyareamendedfromtimeto time.(7) Committee meansa groupof boardmembers,unitowners,orboardmembersan dunitownersappointedbytheboardora memberoftheboardtomakerecommendationstot heboardregardingtheproposedannualbudgeto rtotakeactiononbehalfoftheboard.(8) Commonelements meanstheportionsofthecondominiumproperty notincludedin theunits.(9) Commonexpenses meansallexpensesprop-erlyincurredbytheas sociationin theperformanceof itsduties,includingexpensesspecifiedin s.

6 (10) Commonsurplus meanstheamountofallreceiptsorrevenues,in cludingassessments,rents,orprofits,colle ctedbya condominiumassociationwhichexceedscommon expenses.(11) CONDOMINIUM meansthatformof ownershipofrealpropertycreatedpursuantto thischapter,whichiscomprisedentirelyof unitsthatmaybeownedbyoneormorepersons,an dinwhichthereis,appurtenanttoeachunit,an undividedsharein commonelements.(12) Condominiumparcel meansa unit,togetherwiththeundividedshareinthec ommonelementsappurtenanttotheunit.(13) Condominiumproperty meansthelands,lea-seholds,andpersonalpro pertythataresubjectedtocondominiumowners hip,whetherornotcontiguous,andallimprove mentsthereonandalleasementsandrightsappu rtenanttheretointendedforuseinconnec-tio nwiththecondominium.

7 (14) Conspicuoustype meansboldtypeincapitallettersnosmallerth anthelargesttype,exclusiveofheadings,ont hepageonwhichit appearsand,inallcases, required,it a unit,a leaseof a unitformorethan5 years,ora prospectusorofferingcircularonlywherereq uiredbylaw.(15) Declaration or declarationofcondominium meanstheinstrumentorinstrumentsbywhichac ondominiumis created,astheyarefromtimetotimeamended.( 16) Developer meansapersonwhocreatesacondominiumoroffe rscondominiumparcelsforsaleorleasein theordinarycourseofbusiness,butdoesnotin clude:(a)Anownerorlesseeofacondominiumor cooperativeunitwhohasacquiredtheunitforh isorherownoccupancy;(b)A cooperativeassociationthatcreatesa condo-miniumbyconversionofanexistingresi dentialcoop-erativeaftercontroloftheasso ciationhasbeentransferredtotheunitowners if,followingtheconver-sion,theunitowners arethesamepersonswhowereunitownersofthec ooperativeandnounitsareofferedforsaleorl easetothepublicaspartoftheplanofconversi on;(c)A.

8 Or(d)A state,county,ormunicipalentityactingasal essorandnototherwisenamedasa developerin thedeclarationofcondominium.(17) Division meanstheDivisionofFloridaCondo-miniums,T imeshares,andMobileHomesoftheDe-partment ofBusinessandProfessionalRegulation.(18) Land meansthesurfaceof a legallydescribedparcelofrealpropertyandi ncludes,unlessotherwisespecifiedin thedeclarationandwhetherseparatefromorin cludingsuchsurface, ,if sodefinedinthedeclaration,theterm land maymeanalloranyportionof theairspaceorsubterraneanspacebetweentwo legallyidentifiableelevationsandmayexclu dethesurfaceof a parcelof realpropertyandmaymeananycombinationof theforegoing,whetherornotcontiguous,orma ymeana condominiumunit.

9 (19) Limitedcommonelements meansthosecom-monelementswhicharereserve dfortheuseofacertainunitorunitsto theexclusionof allotherunits,asspecifiedin thedeclaration.(20) Multicondominium meansa realestatedevel-opmentcontainingtwoormor econdominiums,allofwhichareoperatedbythe sameassociation.(21) Operation or operationofthecondominium includestheadministrationandmanagementof thecondominiumproperty.(22) Rentalagreement meansanywrittenagree-ment,ororalagreemen tif forlessdurationthan1 year,providingforuseandoccupancyofpremis es.(23) Residentialcondominium meansa condomin-iumconsistingoftwoormoreunits,a nyofwhichareintendedforuseasa privatetemporaryorpermanentresidence,exc eptthata condominiumis nota residen-tialcondominiumif theuseforwhichtheunitsareintendedisprima rilycommercialorindustrialandnotmorethan threeunitsareintendedto beusedforprivateresidence,andareintended tobeusedashousingformaintenance,manageri al,janitorial,or condomin-iumthatis nota timesharecondominium,a residentialunitincludesa unitintendedasa privatetemporaryorpermanentresidenceaswe llasa time-sharecondominium,thetimeshareinstru mentasde-finedin s.
