10 The Undertaker must also ensure that the reinstatement conforms to prescribed performance standards in the case of an interim reinstatement, until a permanent reinstatement is effected, and, in the case of a permanent reinstatement, for the prescribed period after completion of the reinstatement. The Secretary of State for Transport has approved this Code under powers to issue codes of practice under section 71 of the NRSWA. The Code incorporates the requirements set out in the following regulations: The Street Works (Reinstatement) Regulations 1992, SI 1992 ; The Street Works (Reinstatement) (Amendment) Regulations 1992, SI 1992 No. 3110; and The Street Works (Reinstatement) (Amendment) ( england ) Regulations 2002, SI 2002 No. 1487. Street works have been a devolved matter in Scotland and Wales since the promulgation of constitutional changes with effect from 1999.
