2 ANTONIO CAPUTOP urchased by Mr. ANTONIO CAPUTOF orewordComplete revision of the annex to the 1978 STCW Convention became necessary inorder to clarify the standards of competence required, introduce qualification re-quirements for trainers and assessors, provide effective mechanisms for enforcement ofits provisions and allow greater flexibility in the assignment of functions on board shipand thus broaden the career opportunities of seafarers. No amendment was made tothe articles of the publication contains the Final Act of the 1995 Conference of Parties to the 1978 STCW Convention, resolutions adopted by that Conference, amendments adoptedby the Maritime Safety Committee at its sixty-eighth, sixty-ninth and seventiethsessions, and a complete, consolidated text of the STCW Convention, including itsoriginal articles, revised annex and supporting STCW Code.

3 To which reference ismade within the revised Convention articles and annex provide the legal framework within whichmandatory technical standards contained in part A of the STCW Code are B of the Code provides guidance to assist those involved in educating, training orassessing the competence of seafarers or who are otherwise involved in applyingSTCW Convention provisions. While not mandatory, the guidance given has beenharmonized through discussions within IMO, involving, where appropriate, con-sultation with the international Labour Organization. Observance of this guidancewill achieve a more uniform application of Convention parts of this publication must be studied to fully understand the intent of theConvention and to give full and complete effect to the minimum global standards ofknowledge, understanding, experience and professional competence desired by theStates which are Parties to it, the industry itself and the general public.

4 The Con-vention and part A of the Code form a binding treaty between States, the inter-pretation of which is governed by the Vienna Convention on the Law of Treaties. 5 ANTONIO CAPUTOP urchased by Mr. ANTONIO CAPUTOF orewordThe international Convention on Standards of Training, Certification and Watch-keeping for Seafarers (STCW), 1978, was adopted by the international Conference onTraining and Certification of Seafarers on 7 July 1978 STCW Convention entered into force on 28 April 1984. Since then threeamendments thereto were adopted in 1991, 1994 and 1991 amendments relating to the global maritime distress and safety system(GMDSS) and conduct of trials were adopted by resolution (59) and enteredinto force on 1 December 1992. The 1994 amendments on special training re-quirements for personnel on tankers were adopted by resolution (63) andentered into force on 1 January 1995 amendments were adopted by resolution 1 of the Conference of Parties tothe international Convention on Standards of Training, Certification and Watch-keeping for Seafarers (STCW Conference), which was convened by the InternationalMaritime Organization and met at the Headquarters of the Organization from 26 Juneto 7 July 1995.

6 Resolution 1 is Attachment 1 to the Final Act of the STCW Con-ference. The STCW Conference, by resolution 2, also adopted the Seafarers Training, Certification and Watchkeeping (STCW) Code*(attachment 2 to the FinalAct) and resolutions 3 to 14 (attachment 3 to the Final Act). The STCW Conferencedid not consider for amendment the articles of the 1978 STCW 2 of the STCW Conference and the STCW Code annexed thereto arecontained in the latter part of this publication . The STCW Code contains, in: PartA,mandatory provisions to which specific reference is made in theannex to the STCW Convention and which give, in detail, the minimumstandards required to be maintained by Parties in order to give full andcomplete effect to the provisions of the STCW Convention; and, in PartB,recommended guidance to assist Parties to the STCWC onvention and those involved in implementing, applying or enforcingits measures to give the STCW Convention full and complete effect in auniform manner.

These entered into force on 1 January 1998 amendments, to part A of the Code, relating to enhanced competence incargo handling and stowage, particularly in respect of bulk cargoes, were adopted byresolution (70). They will enter into force on 1 January to part B of the Code were adopted at the 69th and 72nd sessions of theMaritime Safety Committee (MSC) and have been promulgated by STCW circulars( , and ) in 1998 and part of the publication contains the text of: the Final Act of the 1995 STCW Conference; the articles of the 1978 STCW Convention; resolution 1 of the 1995 STCW Conference and the annexed 1995amendments, which completely replace the annex to the 1978 STCWC onvention and the 1991 and 1994 amendments thereto; resolutions 3 to 14 of the STCW Conference.

8 And the 1997 amendments to the footnotes to the text of the regulations of the STCW Convention, which havebeen added by the IMO Secretariat, do not form part of that Convention and havebeen inserted for ease of reference. The IMO Secretariat has been instructed to updatethese references as and when appropriate.
