TRAVEL SERVICES TERMS AND CONDITIONS

1 TRAVEL SERVICES TERMS AND CONDITIONS Welcome to the TRAVEL Loyalty Redemption Program ( Program ) website ( Website ). By accessing or using this Website, redeeming Program points ( Points ), booking any reservations for TRAVEL products or SERVICES on this Website, or contacting our call center agents (collectively, the " TRAVEL SERVICES "), you agree that the following TERMS (the " TERMS ") then in force will apply. If you do not agree to these TERMS , please do not use or book any reservations through this Website or our call center agents.

2 In order to use Points to book TRAVEL , you must be eighteen (18) years of age or older, have enrolled in a participating Program, abide by the Program Rules and have a valid email address. Membership in the Program is void if prohibited by law in any state or country where you have your residence. These TERMS are subject to change at any time and such changes will take effect when the TERMS are updated. Your continued use of the Program after the posting of any such changes is your agreement to the revised TERMS . In these TERMS , the term "you" refers to the customer accessing the TRAVEL SERVICES and/or booking a reservation through the TRAVEL SERVICES .

3 The TERMS "we", "us", or "our," refer to the Program. Please read these TERMS carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than in court. TRAVEL management SERVICES are provided by Aspire Loyalty TRAVEL Solutions, LLC. directly, and through its affiliate, Bridge2 Solutions, LLC ( Aspire ), a service provider to the Program. Aspire acts as a service bureau that provides value added service to retail TRAVEL agents and consumers. In these TERMS , " TRAVEL Suppliers" means the airlines, hotels, car rental agencies, and other service providers whose products and SERVICES are made available through the Program and which may be subject to additional TERMS or policies, including, but not limited to, the rules and restrictions and other policies described in these TERMS .

4 The TERMS incorporate by reference the TERMS of each TRAVEL Supplier s TERMS and CONDITIONS , as applicable. You are responsible for checking the applicable TRAVEL Supplier site(s) for TERMS and CONDITIONS which may be applicable to you. Your use of the TRAVEL SERVICES is also subject to the Bank of America rewards program rules available at: or the Merrill rewards program rules available at: , which govern your participation in the Bank of America and Merrill rewards programs and your use of Points. Bank of America means Bank of America and its subsidiaries and affiliates.

5 USE OF THE TRAVEL SERVICES As a condition of your use of the TRAVEL SERVICES , you warrant that: You are at least 18 years of age; You possess the legal authority to create a binding legal obligation; You will only use the TRAVEL SERVICES to make legitimate reservations for you or for another person for whom you are legally authorized to act; You will inform such other persons about the TERMS that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto; All information supplied by you for TRAVEL SERVICES is true, accurate, current and complete; and You agree to safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.

6 We retain the right at our sole discretion, to deny access to anyone to the TRAVEL SERVICES , at any time and for any reason, including, but not limited to, for violation of these TERMS . 1. DISPUTES We are committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue Claims as explained in this section. Any and all disputes or claims relating in any way to the TRAVEL SERVICES , any dealings with customer service agents, any SERVICES or products provided, or any representations made by the Program ( Claims ) will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify.

7 This includes any Claims you assert against the Program, Bank of America, TRAVEL Suppliers, or any companies offering products or SERVICES through us (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these TERMS , regardless of whether prior versions of the TERMS required arbitration. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys fees and costs), and must follow and enforce these TERMS as a court would.

8 Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules, except as provided in this section. If your total Claims seek less than $10,000, we will reimburse you for filing fees you pay to the AAA and will pay arbitrator s fees. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.

9 Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction. 2. ACCEPTABLE USE You may only use this Website and the Call Center to make legitimate reservations, purchases or requests to purchase the products or SERVICES offered (each, a Request ) and will not use this Website or Call Center to make any speculative, false or fraudulent Requests or any Requests in anticipation of demand.

10 You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this Website or the Call Center. You agree to promptly update your information in order to keep your information current, complete and accurate. It is a violation of law to place a Request in a false name or with an invalid method of payment. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you.
