POSITION RESPONSIBILITIES Lead and oversee all aspects of development, implementation, standardization (where appropriate), and management of the Company s DOT TRUCKING COMPLIANCE Programs, including CMV Files, DOT Driver Qualification Files, DOT Drug/Alcohol Programs, Vehicle Inspections, Hours of Service, etc.

2 Develop and implement standardized processes for Driver Background Checks, Pre-Employment Medical Screening & DOT Physicals, Previous Employer Release of Information, etc. in coordination & conjunction with HR, EH&S, and Operations Personnel Prepare and submit required Federal and State DOT TRUCKING Registrations, Licensing, COMPLIANCE Reports, etc. Conduct incident investigations, root-cause analysis, follow-up, and closure of action items, and leverage learning across organization for all vehicle accidents involving Company personnel and/or equipment. Work with Operations Personnel to implement and manage detailed, proactive systems to ensure COMPLIANCE with Federal and State DOT TRUCKING regulations and Company requirements, with a strong emphasis on a Management Systems approach to COMPLIANCE .

3 Conduct TRUCKING & Transportation applicability determinations, COMPLIANCE audits, and risk assessments to ensure effective and sustainable implementation of Regulatory and Company requirements at each of the truck shops/yards. Review pending and upcoming changes to Federal & State DOT TRUCKING regulations to ensure the Company is prepared for future COMPLIANCE requirements. Develop and communicate impact summaries of future regulatory changes to EH&S Leadership and Operations Management. Seek out industry best practices and more effective and efficient methods to achieve Operational Excellence in Incident Prevention and DOT TRUCKING COMPLIANCE . Lead and oversee all aspects of development, implementation, standardization (where appropriate), and management of the Company s health & Safety COMPLIANCE and Risk Management Programs for Area of Responsibility (AOR).

4 Work with Operations Personnel to implement and manage a proactive, behavior-based approach to health & Safety, with a strong emphasis on Personal Responsibility, Incident Prevention, & a Management Systems approach to COMPLIANCE . Perform health & Safety applicability determinations, COMPLIANCE audits, and risk assessments to ensure effective and sustainable implementation of Regulatory and Company requirements. Conduct incident investigations, root-cause analysis, follow-up, and closure of action items, and leverage learning across organization for all injuries and incidents involving Company personnel and/or equipment in AOR. Review pending changes to Federal, State, and Local health & Safety regulations to ensure the Company is prepared for future COMPLIANCE requirements.

5 Develop and communicate impact summaries of future regulatory changes to H&S Leadership and Operations Management. Seek out industry best practices and more effective and efficient methods to achieve Operational Excellence in Incident Prevention, health & Safety COMPLIANCE , and Risk Management. Provide guidance and interpretations of various Industry & Coalition Group codes and standards ( NFPA, ANSI, etc.) as they relate to OSHA COMPLIANCE and overall health and safety risk management. Assist Operations & Engineering staff regarding health & safety technical guidance, plan/procedure development and implementation, incident notification/response, and other routine COMPLIANCE issues and requests.

6 Division/Department: BKEP Crude, LLC Job Classification: Salaried/Exempt Hourly/Nonexempt Job Code: 1251 Reports to (title): health & Safety MANAGER Updated: 12/18/2012 POSITION REQUIREMENTS in Engineering, Environmental, health & Safety, or related Science Discipline is preferred; equivalent experience will also be considered. Minimum of 10 years direct experience directing DOT, health & Safety TRUCKING regulatory COMPLIANCE & risk management programs, including the oversight & administration of DOT s Drug & Alcohol Programs. Experience in the Petroleum Sector is preferred. Comprehensive knowledge and understanding of Federal and State DOT, health & Safety TRUCKING Regulations, especially the DOT s Federal Motor Carrier Safety Regulations, Hazardous Materials Regulations, Drug & Alcohol Regulations (including Parts 40, 199, & 382), including a working knowledge of the DOT Letters of Interpretation and other Regulatory Guidance Strong leadership and organization, with the ability to direct and achieve priorities, goals, and strategies with limited supervision.

7 Effective written and verbal communication skills and the ability to appropriately target communication to intended audience, ranging from leading Training Presentations for Operations and Management to interactions and meetings with a variety of Agency and Community stakeholders. Proficient knowledge of computers and typical production software ( , MS Office, Outlook, Word, Excel, PowerPoint, etc.), Ability and desire to travel domestically 50-75%. Travel is primarily regional (TX-OK-KS-CO-NM) to Crude Oil TRUCKING & Storage Asset Locations. PHYSICAL REQUIREMENTS Must be able to safely walk up stairs ( , truck racks, etc.), ascend & descend ladders ( , storage tanks, tankers, etc.), and work outdoors in all weather conditions.

8 Very good physical mobility and dexterity to inspect conditions of TRUCKING Assets (top, bottom, side, etc.), loading/unloading connections, etc. Normal physical strength & fitness to handle conditions consistent with crude TRUCKING field operations.
