2 , pursuant to Michigan Compiled Law and Michigan law requires th at the UD-10 be completed in full by the investigating officer and forwarded to the MSP to analyze the cause of the reported Crash and prepare information compiled from such reports for public use. A UD-10 shall not be available for use in a court action but shall be for th e purpose of furnishing stati stical information regarding th e number and causes of crashes pursuant to MCL (1). Every reasonable effort shall be made to obtain factual information for the complet ion of the UD-10 . If this is not poss ible, law enforcement shall use their best judgment and record their considered opinions based on th eir investi gation and experience.

3 This should be done even th ough it may not be possible to substantiate all recorded informatio n or have sufficient evidence to ini tiate enforce ment acti on. A police officer may issue a citatio n to a person who is th e operato r of a motor vehicle involved in a Traffic Crash if, based upon the personal investigation; the officer has reasonable ca use to believe that the person has committ ed a misdemeanor in connectio n with the Traffic Crash , pursuant to MCL (8). Similarly, a police office r may issue a citatio n to a person who is the driver of a motor vehicle involved in a tra ffic Crash if, based upon th e personal investigation; th e officer has reasonable ca use to believe that the person is responsible for a civil infraction in connec tion with the Traffic Crash , pursuant to MCL (3).

4 Every year, UD-10s are used to Report approximately 300,000 Traffic crashes to th e MSP for analysis. The instructions in this Manual are designed to assist law enforcement in reporting Traffic crashes in a complete, accurate and uniform manner so th at the information compiled from such reports will be of the greatest value for Traffic Crash preventi on purposes, including: Traffic enginee rs to redesign unsafe roads and intersec tions. Law enforcement to assign patrols in high Traffic Crash areas. Department of State to update drivi ng rec ords to accurately identi fy drivers in crashes. Road commi ssions to recover repair costs for damage to public property. Federal agencies to develop safety ini tia ti ves, implement safety programs, and contribute tomaking and changing U D - 1 0 I N S T R U C T I O N M A N U A L UD-10 Instruction Manual Traffic Crash Definitions Traffic Crash The UD-10 Traffic Crash Report shall be used to Report all Traffic related motor vehicle crashes to the State of Michigan.

5 The Michigan criteria for a Crash are: DID THE Crash 1. a motor vehicle that 2. was in transport, and 3. on th e roadway , that resulted in death, injury or property damage of $1,000 or more. The Report is also used to record any Crash involving a snowmobile or off-road vehicle (ORV), whether traffi c or non- Traffic related. The property damage for a snowmobile or ORV is $ Exclusions of a Crash include: Deliberate Intent ( , suicide, self-inflicted injury, homicide); Legal Intervention (i .e., pit -maneuver, deliberate acts engaged in by law enforcement.) Note: A pit -maneuver that ca uses the suspect vehicle to colli de with another unit would be reported on a UD-10 as a two unit Crash .

6 FATAL CRASHES In crashes involving fatalities, the State of Michigan requires that all passengers, injured and uninjured, be lis ted on th e Crash Report and that the Crash Diagram and Remarks be completed with a thorough descripti on of the Crash . Include all supplemental reports relating to this Crash . All fatalities occurri ng on non-public highways (d riveways, shopping centers, etc.) shall also be submitt ed. All fatalities must be reported to MSP Operations via the Law Enforcement Information Network (LEIN) using the format shown in Secti on 9. Note: All occupants involved in a fatal Crash must be recorded on th e UD-10 .

7 PARKED VEHICLES Legally Parked vehicle : A LEGALLY parked vehicle is a Traffic unit on th e UD-10 . All occupants (in cluding the person sitting behind the stee ring wheel) of a LEGALLY parked vehicle are passengers. Do NOT include a Driver s License Number (DLN) of th e occupant sea ted behind the wheel. Michigan law does not require a person to have a driver lice nse in order to sit in a legally parked vehicle . Code the person sitting behind the wheel in th e Passenger sec tion in Position 01. Note: An emergency vehicle with lights activated and on the roadway is considered a Legally Parked vehicle . Illegally Parked vehicle : An ILLEGALLY parked vehicle is a traffi c unit on the UD-10 and is considered a moto r vehicle in transport.

8 If the vehicle is ILLEGALLY parked, list the DLN of the occupant seated behind th e stee ring wheel. Notice we have intentionally avoided callin g thi s person th e driver because the car is PARKED, but the person s DLN, name, address, etc., should be listed in th e Driver sec tion of th e UD- 10.
