9 If the appellant fails tocomply within the 14-day period, the clerk will enter an order dismissing theappeal for want of prosecution and issue a certified copy of the order as themandate to the clerk of the district COURT . After the appeal has been dismissedunder this rule, there is no remedy for default except by order of the COURT . Thedismissal of an appeal will not limit the COURT 's authority to take disciplinaryaction against defaulting counsel in appropriate : FRAP 3(a)(2)._____RULE 10A: EXHIBITS(a) Duty of Appellant. Subject to subparagraph (b) of 8 Cir. , appellantthmust ensure that all trial exhibits and all relevant pre-trial exhibits, or copiesthereof, are submitted to the clerk of the COURT APPEALS no later than the filing ofappellant s opening brief.

10 If the trial exhibits and the relevant pre-trial exhibitswere retained by the district COURT , appellant must ask the clerk of the districtcourt to forward the exhibits to the clerk of the COURT of APPEALS . If the trialexhibits and the relevant pre-trial exhibits were not retained by the district COURT ,appellant must prepare and submit a separate appendix containing the exhibits,or copies thereof. In the event appellant fails either to ask the district COURT totransmit the exhibits or to prepare a separate appendix of exhibits, the appelleemay take steps to ensure that all trial exhibits and all relevant pretrial exhibits, orcopies thereof, are submitted to the clerk of the COURT of APPEALS no later than thefiling of appellee s brief.
