3 (h)Theterm"ColoradoRiverCompact"meansthe agreementconcermngtheapportionmentoftheu seofthewatersoftheColoradoRiverSystemdat edNovember24,1922,executedbyCommissioner sfortheStatesofArizona,California,Colora do,Nevada,NewMexico,UtahandWyoming,appro vedbyHerbertHoover,representativeoftheUn itedStatesofAmerica,.andproclaimedeffect ivebythePresidentoftheUmtedStatesofAmeri ca,June25,1929.(i)Theterm"UpperColoradoR iverSystem"meansthatporhonoftheColoradoR iverSystemaboveLeeFerry.(j)Theterm"Commi ssion"meanstheadministrativeagencycreate dbyArticleVIII ofthisCompact.(k)Theterm"wateryear"means thatperiodoftwelvemonthsendingSeptember3 0ofeachyear.(1)Theterm"acre-foot"meansth equantityofwaterrequITedtocoveranacretot hedepthofonefootandisequivalentto43, (m)Theterm"domesticuse"shallincludetheus eofwaterforhousehold,stock,municipal, ,industrialandotherlikepurposes,butshall excludethegenerationofelectricalpower.
4 (n)Theterm"virginflow" (a)Subjecttotheprovisionsandlimitationsc ontainedintheColoradoRiverCompactandinth isCompact,thereisherebyappor-tionedfromt heUpperColoradoRiverSysteminperpetuityto theStatesofArizona, Colorado ,NewMexico,Ut ahandWyoming,re-spectively,theconsumptiv euseofwaterasfollows:(1)TotheStateofAriz onatheconsumptiveuseof50,000acre-feetofw aterperannum.(2)TotheStatesofColorado,Ne wMexico,UtahandWyoming,respectively, ,000acre-feetperannum, - - - - ,StateofNewMexico- - - - - - ,-4-StateofUtah- - - - , (b)TheapportionmentmadetotherespectiveSt atesbyparagraph(a)ofthisArticleisbasedup on,andshallbeappliedinconformitywith,the followingprinciplesandeachofthem:(1)Thea pportionmentisofanyandallman-madedepleti ons;(2)Beneficialuseisthebasis,themeasur eandthelimitoftherighttouse;(3)NoStatesh allexceeditsapportioneduseinanywateryear whentheeffectofsuchexcessuse,asdetermine dbytheCommission,istodepriveanothersigna toryStateofitsapportioneduseduringthatwa teryear.
5 Provided,thatthissub-paragraph(b)(3)shal lnotbeconstruedas:(i)Alteringtheapportio nmentofuse,orobligationstomakedeliveries asprovidedinArticleXI,XlI,XIIIorXIVofthi sCompact;(ii)Purportingtoapportionamongt hesignatoryStatessuchusesofwaterastheUpp erBasinmaybeentitledtounderparagraphs(f) and(g)ofArticleIIIoftheColoradoRiverComp act;or(iii)Countenancingaverageusesbyany signa-toryStateinexcessofitsapportionmen t.(4)TheapportionmenttoeachStateincludes allwater-5-necessaryforthesupplyofanyrig htswhichnowexist.(c)Noapportiorunentishe rebyITlade,orintendedtobeITlade,ofsuchus esofwaterastheUpperBa sinITlaybeentitledtounderparagraphs(f)an d(g)ofArticleIIIoftheColoradoRiverCOIT lpact.(d) ,theextentofcurtailmentbyeachStateofthec onsumptiveuseofwaterapportionedtoitbyArt icleIIIofthisCompactshallbeinsuchquantit iesandatsuchtimesasshallbedeterITlinedby theCommissionupontheapplicationofthefoll oWingprinciples:(a)Theextentandtimesofcu rtailmentshallbesuchastoassurefullcompli ancewithArticleIIIoftheColoradoRiverComp act.
6 (b)IfanyStateorStatesoftheUpperDivision, ,shallhaveconsumptivelyusedmorewaterthan itwasortheywere,asthecasemaybe,entitledt ouseundertheapportionmentmadebyArticleII IofthisCompact,suchStateorStatesshallbe- 6-requiredtosupplyatLeeFerryaquantityofw aterequaltoits, ,asmaybenecessarytoassurecompliancewithA rticleIIIoftheColoradoRiverCompact,befor edemandismadeonanyotherStateoftheUpperDi vision;(c)Exceptasprovidedinsubparagraph (b)ofthisArticle,theextentofcurtailInent byeachStateoftheUpperDivisionofthecon-su mptiveuseofwaterapportionedtoitbyArticle IIIofthisCompactshallbesuchastoresultint hedeliveryatLeeFerryofaquantityofwaterwh ichbearsthesamerelationtothetotalrequi~e d curtailmentofusebytheStatesoftheUpperDiv isionastheconsumptiveuseofUpperColoradoR iverSystemwaterwhichwasmadebyeachsuchSta teduringthewateryearimmediatelypreceding theyearinwhichthecurtailmentbecomesneces sarybearstothetotalconsumptiveuseofsuchw aterintheStatesoftheUpperDivisionduringt hesamewateryear.
7 Provided,thatindeterminingsuchrelationth eusesofwaterunderrightsperfectedpriortoN ovember24,1922, (a) (a) (b)Alllossesofwateroccurringfromorasther esultofthestorageofwaterinreservoirscons tructedafterthesigningofthisCompactshall bechargedasfollows:(1)IftheCommissionfin dsthatthereserVOlrisused,inwholeorinpart ,toassisttheStatesoftheUpperDivisionmmee tingtheirobligationstodeliverwateratLeeF errylmposedbyArticleIIIoftheColoradoRive rCompact,theCommissionshallmakefindmgs,w hichinnoeventshallbecontrarytothelawsoft heUnitedStatesofAmericaunderwhichanyrese rvoirisconstructed, ,ashecasemaybe, (b)(1) (2) ,tosupplywater{orusein':lBStateoftheUppe rDivision, ~ (b)(2)shallbeearmarkedforandchargedtothe Stateinwhichthewaterwillbeused.}
