The General T&Cs and the Product Specific Terms and Conditions together, shall be referred to as Agreement .Unless explicitly stated otherwise, any new feature or features that augment or enhance the current Services ,including the release of or migration to new Services , shall be subject to this Agreement. By completing and submitting the relevant application form for use of the Service or by using or otherwiseaccessing the Service, the Subscriber represents that it has read this Agreement and agrees to be bound by this Agreement, the following words andexpressions have the meanings assigned to themexcept where the context otherwise requires.

9 (i) Addressee of a Data Message or anElectronic Record means a person who isintended by the Originator to receive theData Message or Electronic Record, butdoes not include an intermediary likeTradeStylus who sends, receives, stores orprovides other service with respect to theData Message or Electronic Record onbehalf of the Originator or Address;(ii) Application Form means the applicationform pursuant to which the Subscribersubscribes for the Services , a copy ofwhich accompanies this Agreement;(iii) TradeStylus is a reference to theTradeStylus entity whose name appearson the Application Form, and in theabsence of such name refers toTradeStylus;(iv) Data Message means informationgenerated, sent, received or stored byelectronic, optical or similar means,including but not limited to electronic datainterchange (EDI), electronic mail,telegram, telex or telecopy.

10 (v) Digital Signature means data inelectronic form in, affixed to, or logicallyassociated with, a Data Message or anElectronic Record, which may be used toidentify the signatory in relation to theData Message or Electronic Record andindicate the signatory s approval of theinformation contained therein; and areference to Digitally Sign shall beconstrued accordingly;(vi) Electronic Record means a recordgenerated in digital form by anInformation System, which can be:(a)transmitted from an InformationSystem or from one InformationSystem to another; and(b)stored in an Information System orother medium;(vii) Information System means a system forgenerating, sending, receiving, storing orotherwise processing Data Messages orElectronic Records;(viii) Insolvency Event means the happeningof any of these events in relation to theSubscriber:a)the Subscriber suspends payment of itsdebts;b)the Subscriber becomes an externally-administered body corporate undertheCorporations Act2001(Cth).
