2 All documents must be presented in Spanish or English. Documents in Chinese or other languages will also be accepted as long as they are officially translated into Spanish or English. Applicants might be invited for an interview concerning the visa application. Working hours: Visa application submission and collection from 9am to 1pm, Monday to Friday, excluding bank holidays. The Spanish Royal Decree 240/2007 transposes the European Parliament and Council Directive 2004/38/EC which regulates the conditions in which Union citizens and their families exercise their right to move and reside freely within the European Union, the right of permanent residence and restrictions on the aforementioned rights on grounds of public policy, public security or public health.

3 Only for the purposes of the Royal Decree 240/2007 "EU Citizen Family Member" covers the following relatives only if the applicant accompanies or joins his/her EU relative in Spain: a) the spouse b) the partner with whom the Union citizen has contracted a registered partnership c) the direct children who are under the age of 21 or are dependants and those of the spouse* or partner d) the dependent direct parents in the ascending line and those of the spouse* or partner Please note that whether you are required to apply for a visa and your EU relative is not accompanying or joining with you in Spain, in that case, you should apply for an ordinary Schengen visa.

4 Do the EU citizens Family Members need a visa to enter Spain? Family members who are not nationals of a Member State shall only be required to have an entry visa in accordance with Regulation (EC) No 539/2001. For holders of a Hong Kong , Macao and BN(O) passport: visa-free entry for Schengen countries up to 90 days. If you plan to stay longer than 90 days you have to apply for a EU citizen Family Member Residence Card at the nearest Foreigners Office (Oficina de Extranjeros), Holders of Hong Kong Document of Identity (HKDI), Macao Travel Document, People s Republic of China, India, Indonesia or Philippines passports, among other nationalities, need to apply for an entry visa according to Regulation EC 539/2001.

5 For other nationalities please check our website. However, they will not need a visa if they hold an EU citizen s relative residence ID issued by any country part of the European Economic Area (the EU countries, Iceland, Norway, Liechtenstein or Switzerland). Where should I apply for a Visa? Only Hong Kong/Macao residents can apply for a visa at this Consulate General of Spain in Hong Kong. 6 - If you intend to visit several Schengen countries, you must apply at the Consulate of the country which is your main destination in terms of length or purpose of stay. - If you visit more than one Schengen country and the main destination cannot be determined, you must apply at the Consulate of the country which is your first point of entry. - If you do not need a visa for the Schengen country which is your main destination or first point of entry, please note that you may require a visa for other Schengen countries that you intend to visit during your trip. The fields marked with * shall not be filled by family members of EU, EEA or CH citizens.

7 The EU, EEA or CH citizen must sign at field 37. Without his/her signature application cannot be accepted. Working hours: Visa application and collection from 9am to 12pm, Monday to Friday, excluding bank holidays. Processing Time and Fees In general, this visa will be ready within 7-10 working days. The visa fee for EU Citizens Family Members is free. REQUIREMENTS 1 **Original documents must be provided** Please note that the Consulate General reserves the right to request additional documents. 1. Application form (download) duly filled in and signed by the applicant and his EU relative. 2. One recent colour photo, passport sized, white background.

8 3. Passport of the applicant (plus 1 photocopy), which must be valid for at least three months after the intended date of departure from the territory of the Member States. It shall contain at least 2 blank pages and shall have been issued within the previous 10 years. 4. Hong Kong / Macao ID card (plus 1 photocopy) of the applicant. (For non-permanent HK resident, HK Visa is also required) 5. Passport of EU citizen (plus 1 photocopy). If the EU citizen is not living in HK or Macau, a Certified True Copy of his / her Passport / DNI, will be required. 6. Hong Kong / Macao ID card of EU citizen.

9 (plus 1 photocopy) If the EU citizen lives in Spain, his certificado de empadronamiento . 7. The document (Marriage Certificate / Birth Certificate) which proves the family relationship (plus 1 photocopy). (for Spanish National, the Libro de Familiar is needed) The certificate must be legalised if it has not been issued in Hong Kong or Macao. For the case of marriage, if you want to live in Spain with your EU spouse, document must be provided proofing your marriage is recognized under the law of that EU country. 8. If the visa applicant is the father/mother of an EU citizen, he/she must prove that depends economically on his/her EU relative.

10 9. Round trip flight booking of the applicant and his/her EU relative. (This Consulate General suggest you not to pay the ticket until your visa is issued) 10. Minors must submit the visa application together with both parents. Applicant must also provide the minor s birth certificate. If this certificate has not been issued in Hong Kong or Macao it must be legalised and translated into Spanish or English. If the minor is not travelling with both parents, it must include a written consent signed by both parents with their phone numbers; otherwise application will not be accepted.
