2 In this Contract, Customer means Small Customer which refers to Re sidential Customers (and business Customers co nsuming less than 100 MWh of electricity in any 12 month period). The Seller is Enwave Central Park Pty Ltd ACN 601 611 330 (Enwave) of Level 26, 135 King Street, Sydney, NSW, 2000, Australia, which owns and operates the Central Thermal Plant at C entral Park, and owns and operates an embedded electricity network at C entral Park. The Seller has appointed Flow Systems Pty Ltd (Flow) trading as Central Park Plus (Central Park Plus), to act as its agent in its dealings with electricity customers at Central Park. 3 Details about your additional rights to cancel this Co ntract are set out at 7 Welcome to Central Park v5 IMPORTANT INFORMATIONThis section provides important information for Small Customers, including information about how the Seller is regulated and what a Customer can do if it wishes to change to another authorised Retailer, make a complaint or report an electrical emergency. This section forms part of the Contract. Embedded Network: Customers at Central Park are part of an Embedded Network. Therefore, they should not be charged by their Retailer (or the Seller) the pass- through Ausgrid network charges, as these Ausgrid charges are not applicable to customers on Embedded Networks. However, the Seller will be charged by Ausgrid for network charges on the total consumption of electricity by all customers at the Site.

4 As a result, the Seller will charge the Customer for Network Services for being on the Embedded Network, and these charges will be exactly the same as if they would have been from Ausgrid. This is called Shadow Pricing as defined in the Australian Energy Regulator Network Exemption Guidelines and ensures the Customer is no worse off by being on an Embedded Network. Seller s Exemption: The Seller is exempt from being an authorised Retailer under the National Energy Retail Law and is not subject to all the obligations of an authorised Retailer. This means that Customers will not receive the same protections as buying from an authorised Retailer. However, the Seller s exemption from being an authorised Retailer is subject to certain conditions. The Seller is also exempt from the requirement to be a registered network services provider under the National Energy Retail Law.

5 However, the Seller s exemption from the requirements to be a registered network services provider is also subject to certain conditions. The Seller must comply with both sets of exemption conditions in its dealings with Customers. For the exemption conditions under which the Seller operates, please visit Australian consumer protection laws: This Contract is covered by Australian consumer protection laws. These laws are separate to your contract with your Retailer and Distributor. This Contract is governed by the National Energy Retail Law. Switching to a new Retailer and related Metering options: Under the laws of New South Wales, Customers have the right to purchase electricity from their choice of authorised Retailer. For Small Customers in the Central Park development, the Meter may need to be changed to enable switching to a new Retailer.

6 Any costs involved in such a change are not payable by the Seller or its agents. Information on Metering options that would allow switching to a new Retailer should be sought from the proposed new Retailer. Tariffs and charges: The tariffs and all associated fees and charges under this Contract for Network Services and (if selected by the Small Customer) Electricity Supply are set out in the Energy price fact sheet provided at the time of registration for this Contract.

7 This Contract describes how those tariffs, fees and charges can change from time to time. Rebates and concessions: Please visit for information about government or non-government electricity rebates, concessions or relief schemes for which Small Customers may be eligible. Flexible payment options: Flexible payment options are available to you in relation to the sale of energy, such as arrangements for payment by periodic instalments (Bill Smoothing) described in clause Small Customers should contact Central Park Plus for more information. Payment difficulties: Small Customers unable to pay an electricity bill due to financial difficulty should contact Central Park Plus or visit for information about the forms of assistance that may be available and the process to follow to seek these forms of assistance.

8 This Contract sets out some of the forms of assistance that may be available and the process to be followed by you to seek these forms of assistance. Rights in relation to dispute resolution: Small Customers who have a complaint about a matter relating to this Contract should contact Central Park Plus on 1300 803 803 or by email on The Seller s complaints handling procedure is also available from the website and explained in more detail in clause of this Contract. If you are a tenant, in the absence of a determination of the relevant tenancy tribunal, we will make reasonable endeavours to resolve your dispute. Small Customers also have a right to refer any unresolved complaints or disputes under this Contract to the Energy and Water Ombudsman New South Wales (EWON) or any other relevant external dispute resolution body in the state or territory in which you are located.

9 EWON is an independent disputes resolution body that can investigate and resolve many disputes under this Contract. To obtain details of EWON s services visit or call EWON on 1800 246 545. Emergencies and faults: In the event of electricity-related emergency or fault, please call 1300 803 TERMSIn addition to the Important Information section above, the rest of this document sets out the terms of our Contract for the sale and delivery of electricity. 1. The PartiesThis Contract is between the Seller, who sells Network Services and, if you choose, also Electricity Supply, to you at the Premises and you, the Customer to whom this Contract applies. 2. Definitions and interpretation(a) terms starting with a capital letter used in this Contract are defined in clause 24.
