Fleischner, Center for Public Representation Introduction Development of guardianship Law in Massachusetts guardianship is a process by which a state, usually acting through its courts, assumes the responsibility to protect the assets and the person of an individual who cannot do so himself or herself. This is an Extraordinary exercise of governmental authority. It allows the state, in effect, to strip individuals of their rights to make decisions about their own lives and their own property and to invest in another -- called a guardian -- the authority to do so for them.
