SAFLII Note: Certain personal / private details of parties or witnesses have been redacted from this document in compliance with the law and SAFLII PolicyREPORTABLEIN THE HIGH COURT OF SOUTH AFRICA(NORTH GAUTENG HIGH COURT, PRETORIA)CASE No. 23010/2004 DATE:20/04/2011In the matter between:-MOLOKE BENNET PITSI No. 51561/2010 MOLOKE BENNET PITSI der Byl, AJ:-Introduction[1] This is a joint judgment in the above two matters, Case No. 23010/2004 and Case No. 51561/2010, both of which served before me on 24 February 2011, 25 February 2011 and 28 March 2011.[2] It is common cause that the parties were married to each other during 1994 and that a child, N D ("the child'), was born out of their marriage on 21 June 1997.[3] The parties were, after the Respondent together with the child left the common home on 18 May 2004, divorced on 6 March 2008 on the occasion of which a deed of settlement concluded between the parties was made an order of Court in terms of which, inter alia, primary residence of the child was vested in the Respondent and Certain rights of contact with the child were granted to the Applicant as the father of the child.
