3 L 3, , p. 1) amended by 2006/911/EC (OJ No. L 346, , p. 41) amended by 2006/104/EC (OJ No. L 363, , p. 352) amended by 2007/729/EG (OJ 294, , p. 26) Whereas: 97/12/EC Whereas important progress has been made in the harmonization of the veterinary field, in particular through the adoption by the Coun-cil of directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market, directive 91/496/EEC of 15 July 1991 laying down the principles governing the organization of veterinary checks on animals entering the Community from third countries and amending Directives 89/662/EEC, 90/425/EEC and 90/675/EEC, directive 85/511/EEC of 18 November 1985 Community measures for the control of foot-and-mouth disease and directive 92/119/EEC of 17 December 1992 introducing 1general Community measures for the control of certain animal diseases and specific measures relating to swine vesicular dis-ease; Whereas the council in its resolution 94/C 16/01 of 22 December 1993 on the strengthening of veterinary epidemiological surveillance measures agreed to do everything in its power to ensure rapid implementation of the principles of that resolution in the context of the amendment of directive 64/432/EEC of 26 June 1964 on health problems affecting intra-Community trade in bovine ani-mals and swine.

4 Whereas it is necessary, in the light of this situation, to amend directive 64/432/EEC in particular as regards the period of residence in a Member State prior to movement, rules for trade in animals under 15 days old, rules for control of certain diseases and rules applicable to assembly centres, transporters and dealers; Whereas for the purpose of rapid and accurate tracing of animals for animal health reasons each Member State should create a comput-erized database which shall record the identity of the animals, all holdings on their territory and the movements of the animals; Whereas directive 64/432/EEC has been substantially amended on a number of occasions; whereas for the sake of clarity that directive should be updated, HAS ADOPTED THIS directive : 98/46/EC Whereas in Article 16 of directive 64/432/EEC the Commission has been requested to make proposals to amend Annexes A, D (Chapter I) and F to the said directive , in particular with regard to their adaptation to technological developments; Whereas in the same Article it is stipulated that the council is to decide on these proposals by a qualified majority before 1 January 1998.

5 Whereas in recent times the development of veterinary administrative procedures regarding herd management, animal movement con-trol, animal identification and information handling in relation to disease control requires amendments to be made to certain Annexes to directive 64/432/EEC , HAS ADOPTED THIS directive : 98/99/EC Whereas the adoption of directive 97/12/EC provided an improved legal basis for implementation of measures to prevent spread of animal diseases via trade in live bovine animals and swine; Whereas directive 97/12/EC contained special requirements for further updating of the criteria for defining the health status of animal populations at herd, region and Member State level as regards bovine tuberculosis, bovine brucellosis and enzootic bovine leu-cosis; whereas the updating of these criteria should, based on a proposal submitted to the council before July 1997, have been decided before 1 January 1998; Whereas the review carried out by the council of diagnostic procedures of most importance for implementation of effective surveillance and monitoring programmes for bovine tuberculosis, bovine brucellosis and enzootic bovine leucosis included in-depth examina-tion of laboratory testing methods and resulted in time-consuming deliberations; Whereas the changes required for updated monitoring programmes and surveillance programmes cannot be implemented in this field at short notice; Whereas in accordance with directive 97/12/EC swine intended for intra-Community trade are no longer subjected to brucellosis testing prior to departure.

6 Whereas, this provision should be anticipated in order to facilitate trade between the Member States; Whereas to avoid obstacles in intra-Community trade and to ensure uniform application of the provisions, harmonised rules concerning the use and the issue of health certificates should be laid down for the period until the date by which the Member States have to comply with the amended provisions of council directive 64/432/EEC of 26 June 1964 on health problems affecting intra-Community trade in bovine animals and swine; Whereas on 24 June 1998 the council adopted directive 98/46/EC to amend the Annexes A, D (Chapter I) and F of directive 64/432/EEC ; whereas owing to this amendment certain references in directive 97/12/EC have changed; Whereas this fact has been taken into account by attaching a table of correspondence in Annex II to directive 98/46/EC; whereas for the sake of improved clarity and of the coherence of the legal texts it is necessary to correct the references in the corresponding ar-ticles; Whereas it is therefore necessary to amend directive 97/12/EC in particular as regards the period made available for Member States to transpose and introduce new rules for disease monitoring and surveillance, HAS ADOPTED THIS directive : 2000/15/EC (1) Both directive 64/432/EEC and council Regulation (EC)No 820/97 of 21 April 1997 establishing a system for the identification and registration of bovine animals and regarding the labelling of beef and beef products refer to the creation of computer data-bases,for bovine and porcine animals,to store information on animals and their movements.

7 (2) The appropriate implementation of functional national databases for recording the movements of porcine animals must be en-sured, HAVE ADOPTED THIS directive : 2000/20/EC (1) directive 64/432/EEC has been amended and updated by directive 97/12/EC and by directive 98/46/EC. (2) Problems concerning the implementation of directive 64/432/EEC as amended by the two aforementioned Directives require transitional measures to avoid disturbances in trade in live animals of the bovine and porcine species. (3) Moreover, directive 64/432/EEC and council Regulation (EC)No 820/97 of 21 April 1997 establishing a system for the identifi-cation and registration of bovine animals and regarding the labelling of beef and beef products refer to the creation of computer databases, inter alia for bovine animals, to store information on animals and their movements. (4) Problems have been encountered with the application of the animal health conditions and in particular in relation to the link with the identification and registration of animals.

8 (5) directive 64/432/EEC is to be amended to ensure consistency of Community rules and to allow the Commission to adopt transi-tional measures allowing the Member States to adapt to the new trade conditions. 2(6) As a result, it is appropriate to delay the entry into force of certain provisions in the said directive . (7) The measures necessary for the implementation of this directive should be adopted in accordance with council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commis-sion, HAVE ADOPTED THIS directive : 2001/298/EC (1) As required by Article 13(3)of directive 91/628/EEC, the Commission has adopted on 6 December 2000 a report on the experi-ence acquired by Member States since the implementation of council directive 95/29/EC of 29 June 1995 amending directive 91/628/EEC concerning the protection of animals during transport.

9 (2) On the basis of the conclusions of this report, and in particular in order to draw the attention of the veterinarians in charge of the certification to their responsibilities concerning the protection of animals during transport, it is necessary to supplement the health certificates provided for these animals. (3) council directive 64/432/EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine, as last amended by Commission Decision 2000/504/EC (7), council directive 90/426/EEC of 26 June 1990 on animal health conditions governing the movement and import from non-member countries of equidae, last amended by Act of Accession, council directive 91/68/EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals, last amended by Commission Decision 94/953/EC, directive 92/65/EEC and Commission Decision 94/273/EC of 18 April 1994 concerning veterinary certification for placing on the market in the United Kingdom and Ireland of dogs and cats not originating in those countries, should therefore be amended accordingly.

10 (4) The additional statement introduced in the present Decision does not exempt transporters from their obligations in accordance with Community provisions in force in particular regarding the fitness of animals to be transported. (5) The measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee, HAS ADOPTED THIS DECISION: (EC) No 535/2002 (1) On 11 October 1999 the Scientific Committee on Animal Health and Animal Welfare adopted a report on the modification of technical Annexes to directive 64/432/EEC to take account of scientific developments regarding tuberculosis, brucellosis and enzootic bovine leucosis. (2) In accordance with the above report, the tests for brucellosis should be carried out in line with the Manual of Standards for Diagnostic Tests and Vaccines, Third Edition, 1996, of the Office International des Epizooties (OIE).
