Texas (1954).(h-3)AAForanysocialstudiesco ursein therequiredcurriculum:(1)AAa teachermaynotbe compelledto discussaparticularcurrenteventorwidelyde batedandcurrentlycontroversialissueof publicpolicyor socialaffairs;(2)AAa teacherwho choosesto discussa topicdescribedby Subdivision(1)shall,to thebestof theteacher s ability,strivetoexplorethetopicfromdiver seandcontendingperspectiveswithoutgiving deferenceto any one perspective;(3)AAa schooldistrict,open-enrollmentchartersch ool,or teachermay not require,makepartof a course,or awarda gradeor coursecredit,includingextracredit,for a student s:(A)AApoliticalactivism,lobbying,or effortstopersuademembersof thelegislativeor executivebranchat thefederal,state,or locallevelto takespecificactionsby directcommunication;or(B)AAparticipation in any internship,practicum,or similaractivityinvolvingsocialor publicpolicyadvocacy.

4 And(4)AAa teacher,administrator,or otheremployeeof ,schooldistrict,or open-enrollmentcharterschoolmay not:(A)AAberequiredtoengageintraining,or ientation,or therapythatpresentsanyformof raceor sexstereotypingor blameon the basisof raceor sex;(B)AArequireor makepartof a coursethe conceptthat:(i)AAone raceor sex is inherentlysuperiorto anotherraceor sex;(ii)AAanindividual,byvirtueoftheindi vidual s raceor sex,is inherentlyracist,sexist,oroppressive,whe therconsciouslyor unconsciously;(iii)AAan individualshouldbe discriminatedagainstor receiveadversetreatmentsolelyor partlybecauseofthe individual s race;(iv)AAmembersof one raceor sex cannotandshouldnot attemptto treatotherswithoutrespectto raceor sex;(v)AAanindividual smoralcharacter,standing,or worthis necessarilydeterminedby theindividual sraceor sex;(vi)AAanindividual,byvirtueoftheindi vidual s raceor sex,bearsresponsibilityforactionscommitt edin the pastby othermembersof the sameraceor sex;(vii)AAan individualshouldfeeldiscomfort,guilt,ang uish,or anyotherformof psychologicaldistressonaccountof the individual s raceor sex;(viii)AAmeritocracyor traitssuchas a sexistor werecreatedby membersof aparticularraceto oppressmembersof anotherrace;(ix)AAthe adventof slaveryin the territorythatis now the UnitedStatesconstitutedthe truefoundingof theUnitedStates;or(x)AAwithrespectto theirrelationshiptoAmericanvalues,slaver yandracismareanythingotherthandeviations from,betrayalsof,or failuresto liveup to,theauthenticfoundingprinciplesof the UnitedStates,whichincludelibertyand equality;and(C)AArequirean understandingof The 1619 Project.

5 (h-4)AAA stateagency,schooldistrict,or open-enrollmentcharterschoolmaynotaccept privatefundingforthepurposeofdevelopinga curriculum,purchasingor selectingcurriculummaterials,orproviding teachertrainingorprofessionaldevelopment for a coursedescribedby Subsection(h-3)(3).(h-5)AAA schooldistrictor open-enrollmentcharterschoolmay not implement,interpret,or enforceany rulesor studentcodeof conductin a mannerthatwouldresultin thepunishmentof astudentfordiscussing,or havea chillingeffecton studentdiscussionof, the conceptsdescribedby Subsection(h-3)(4). (a)AAExceptas providedby Subsection(b)ofthissection,thisAct appliesbeginningwiththe 2021-2022schoolyear.(b) (h-2),EducationCode,as addedby thisAct,appliesbeginningwiththe laterthanDecember31, 2022,the Educationshallreviewandrevise,as needed,theessentialknowledgeand skillsof the socialstudiescurriculumas requiredby (h-2),EducationCode,as addedby any provisionof thisAct or its applicationto any personor circumstanceis heldinvalid,the invaliditydoesnot affectotherprovisionsor applicationsof thisAct thatcan begiveneffectwithoutthe invalidprovisionor application,and tothisend the provisionsof thisAct are declaredto be takeseffectimmediatelyif it receivesa voteof two-thirdsof all the memberselectedto eachhouse,asprovidedby Section39, ArticleIII, thisAct doesnot receivethe votenecessaryfor immediateeffect,thisAct takeseffectSeptember1, the SenateSpeakerof the HouseAAAAAAI 3979was passedby the Houseon May11, 2021,by the followingvote.
