1 DCJS Date Prepared: 02-23-2021 Annual Jail Population Trends New York City and each county in the state operate local jails, which house individuals sentenced to no more than one year of incarceration, those awaiting transfer to state prison to serve a sentence longer than one year, and those whose court cases are pending. This report details average daily census figures based on daily counts submitted by each jail to the state Commission of Correction. New York City jail Population figures have been reported to the state since 2016. As a result, New York State and New York City data are shown annually from 2016 through 2020.

2 Data for the Non-New York City region and each county outside of the five boroughs are shown annually from 2011 through 2020. The average daily census reported by jails has decreased statewide since 2016. The Population continued to decline in 2019 and 2020, the result of fewer arrests and arraignments because of the COVID-19 pandemic and changes related to bail reforms that took effect Jan. 1, 2020. Population decreases during this time also are attributable in part to the state s Raise the Age law, which prohibits the detention of 16- and 17-year-olds in county and New York City jails.

3 Data are presented in the following categories: Census: The average daily number of individuals for which the facility is responsible, whether they are housed at the jail (In House) or another facility (Boarded Out). Boarded In: The average daily census of individuals from other jurisdictions housed at the facility, except those in federal custody. These individuals are not included in a facility s average daily census. Each facility s In-House Population is further categorized by the status of individuals physically housed there: Sentenced: Individuals who have been convicted and sentenced to a jail term.

4 Civil: Individuals incarcerated as a result of a civil process, Family Court proceeding, Contempt or Material Witness status. Federal: Individuals incarcerated who are custody of a Government Agency. Technical Parole Violators: Individuals held on a warrant issued as result of a violation of a condition of parole. State Readies: Individuals sentenced by the court to a state prison term but not yet transferred to the custody of the state Department of Corrections and Community Supervision. Other Unsentenced: Individuals who are awaiting arraignment, trial or sentencing by the court or who have violated conditions of parole because they have been re-arrested for a new crime.
