4 Code (relating to applicability). GENERAL PROVISIONS Purpose.(a) The purpose of this CHAPTER is to protect the health, safety and well-beingof PERSONAL care home SERVICES MANUALPt. IV2600-4(397650) No. 541 Dec. 19 Copyright 2019 Commonwealth of Pennsylvania(b) PERSONAL care HOMES are designed to provide safe, humane, comfortableand supportive residential settings for adults who do not require the services inor of a licensed long-term care facility, but who do require assistance or supervi-sion with activities of daily living, instrumental activities of daily living, or who live in PERSONAL care HOMES that meet the requirements in thischapter will receive the encouragement and assistance they need to develop andmaintain maximum independence and self-determination. Scope.(a) This CHAPTER applies to PERSONAL care HOMES as defined in this CHAPTER , andcontains the minimum requirements that shall be met to obtain a license to oper-ate a PERSONAL care home .

5 (b) This CHAPTER does not apply to commercial boarding HOMES or to facilitiesoperated by a religious organization exclusively for the care of clergy or otherindividuals in a religious profession. Inspections and licenses.(a) The Department will annually conduct at least one onsite unannouncedinspection of each PERSONAL care home .(b) A license will be issued to the legal entity by the Department if, after aninvestigation by an authorized agent of the Department, the requirements for alicense are met.(c) The PERSONAL care home shall post the current license, a copy of the cur-rent license inspection summary issued by the Department and a copy of thischapter in a conspicuous and public place in the PERSONAL care home . following words and terms, when used in this CHAPTER , have the followingmeanings, unless the context clearly indicates otherwise:ADL Activities of daily living The term includes eating, drinking, ambu-lating, transferring in and out of a bed or chair, toileting, bladder and bowelmanagement, PERSONAL hygiene, securing health care , managing health care ,self-administering medication and proper turning and positioning in a bed The occurrence of one or more of the following acts:(i) The infliction of injury, unreasonable confinement, intimidation orpunishment with resulting physical harm, pain or mental anguish.

6 (ii) The willful deprivation by the PERSONAL care home or its staff per-sons of goods or services which are necessary to maintain physical or mentalhealth.(iii) Sexual harassment, rape or abuse, as defined in 23 Chapter61 (relating to protection from abuse).(iv) Exploitation by an act or a course of conduct, including misrepre-sentation or failure to obtain informed consent which results in monetary, PERSONAL or other benefit, gain or profit for the perpetrator, or monetary orpersonal loss to the 2600 PERSONAL care HOMES55 (381403) No. 502 Sep. 16(v) Neglect of the resident, which results in physical harm, pain ormental anguish.(vi) Abandonment or desertion by the PERSONAL care home or its An individual who is 18 years of age or staff person An individual who provides services for the residentsother than activities of daily An individual authorized by the Department to enter, visit, inspect orconduct an investigation of a PERSONAL care assessment agency An organization serving adults who areolder or adults with disabilities, such as a county mental health/intellectual dis-ability agency, a drug and alcohol agency, an area agency on aging or anotherhuman service agency, or an individual in an occupation maintaining contactwith adults who are older and adults with disabilities, such as medicine, nurs-ing or rehabilitative Complementary and alternative medications Practices, substancesand ideas used to prevent or treat illness or promote health and well-being out-side the realm of modern conventional medicine.

7 Alternative medicine is usedalone or instead of conventional medicine. Complementary medicine is usedalong with or in addition to conventional Cardiopulmonary boarding home A type of residential living facility providingonly food and shelter, or other services normally provided by a hotel, for pay-ment, for individuals who require no services beyond food, shelter and otherservices usually found in hotel or apartment A written or oral criticism, dispute or objection presented by oron behalf of a resident to the Department regarding the care , operations ormanagement of a PERSONAL care Calendar A clinical syndrome characterized by a decline of long durationin mental function in an alert individual. Symptoms of dementia may includememory loss, personality change, chronic wandering and the loss or diminish-ing of other cognitive abilities, such as learning ability, judgment, comprehen-sion, attention and orientation to time and place and to The Department of Human Services of the person An individual who may be chosen by the resident anddocumented in the resident s record, to be notified in case of an emergency,termination of service, PERSONAL care home closure or other situations as indi-cated by the resident or as required by this CHAPTER .

IV2600-6(381404) No. 502 Sep. 16 Copyright 2016 Commonwealth of PennsylvaniaDirect care staff person A staff person who directly assists residents withactivities of daily living, and instrumental activities of daily living and providesservices or is otherwise responsible for the health, safety and well-being of medical plan A plan that ensures immediate and direct accessto medical care and treatment for serious injury or illness, or management (i) A PERSONAL care service provided whenever the administrator servesas representative payee or as a guardian or power of attorney assigned priorto December 21, 1988, for a resident, or when a resident requests andreceives assistance in budgeting and spending of the PERSONAL needs allow-ance.

9 (ii) The term does not include solely storing funds in a safe place as aconvenience for a safety expert A member of a local fire department, fire protectionengineer, Commonwealth-certified fire protection instructor, college instructorin fire science, county or Commonwealth fire school, volunteer trained andcertified by a county or Commonwealth fire school, an insurance company losscontrol representative, Department of Labor and Industry building code inspec-tor or construction code Instrumental activities of daily living The term includes the follow-ing activities when done on behalf of a resident:(i) Doing laundry.(ii) Shopping.(iii) Securing and using transportation.(iv) Managing finances.(v) Using a telephone.(vi) Making and keeping appointments.(vii) Caring for PERSONAL possessions.(viii) Writing correspondence.(ix) Engaging in social and leisure activities.(x) Using a prosthetic device.

10 (xi) Obtaining and keeping clean, seasonal entity A person, society, corporation, governing authority or partner-ship legally responsible for the administration and operation of a PERSONAL A certificate of compliance issued by the Department permittingthe operation of a PERSONAL care home , at a given location, for a specific periodof time, for a specified capacity, according to CHAPTER 20 (relating to licensureor approval of facilities and agencies).Long-term care ombudsman A representative of the Office of the StateLong-Term care Ombudsman in the Department of Aging who investigates andseeks to resolve complaints made by or on behalf of individuals who are 60Ch. 2600 PERSONAL care HOMES55 (311267) No. 368 Jul. 05years of age or older who are consumers of long-term care services. Thesecomplaints may relate to action, inaction or decisions of providers of long-termcare services, of public agencies, of social service agencies or their representa-tives, which may adversely affect the health, safety, well-being or rights ofthese resident (i) A resident who is physically and mentally capable of vacating thepersonal care home on the resident s own power or with limited physical ororal assistance in the case of an emergency, including the capability to ascendor descend stairs if present on the exit path.
