Participation of employees in the formulation and implementation of personnel policies affecting 3 them contributes to effective conduct of school business. 4 5 2. The efficient administration of the system of public instruction and well-being of employees 6 requires that orderly and constructive relationships be maintained BETWEEN the parties hereto. 7 8 3.
3 Subject to law and the paramount consideration of service to the public, employee-management 9 relations should be improved by the appropriate application of the Public Employees COLLECTIVE 10 BARGAINING Act. 11 12 4. Effective employee-management cooperation requires a clear statement of the respective rights and 13 obligations of the parties hereto. 14 15 5. It is the intent and purpose of the parties hereto to promote and improve the efficient administration 16 of the District and the well-being of employees within the spirit of the Public Employees 17 COLLECTIVE BARGAINING Act. 18 19 20 21 P R E A M B L E 22 23 This AGREEMENT is made and entered into BETWEEN Auburn School District (hereinafter "District" or 24 "Employer") and Auburn Association of Educational Office Professionals, an affiliate of Public School 25 Employees of Washington/SEIU 1948 (hereinafter "Association").
4 26 27 In accordance with the provisions of the Public Employees COLLECTIVE BARGAINING Act (RCW ) 28 and regulations promulgated pursuant thereto, and in consideration of the mutual covenants contained 29 therein, the parties agree as follows: 30 31 32 33 A R T I C L E I 34 35 RECOGNITION AND COVERAGE OF AGREEMENT 36 37 Section 38 The District hereby recognizes the Association as the exclusive representative of all employees in the 39 BARGAINING unit described in Section , and the Association recognizes the responsibility of 40 representing equally and fairly the interests of all such employees. 41 42 Section 43 Nothing contained herein shall be construed to include in the BARGAINING unit any person whose duties 44 as deputy, administrative assistant, or secretary necessarily imply a confidential relationship to the 45 Board of Directors or Superintendent of the District pursuant to RCW (2).
5 46 47 48 2016 - 2019 COLLECTIVE BARGAINING AGREEMENT Page 2 of 33 PSE of Auburn AAEOP/Auburn School District #408 September 1, 2016 Section 1 The District will provide the Association with job descriptions and such amendments, changes, and 2 additions to job descriptions within the BARGAINING unit as they may from time to time occur. 3 Consistent with the intent of Section of this AGREEMENT , rates of pay for newly created positions 4 essentially different from positions presently covered by the AGREEMENT will be negotiated with the 5 Association. 6 7 Section 8 The Office Manager at each work site will have the opportunity for input on the scheduling of 9 assistants time for maximum affect on workload issues within the parameters of the Office 10 Assistant s job description.
6 11 12 Section 13 The BARGAINING unit to which this AGREEMENT is applicable shall consist of all classified employees in 14 the following general job classifications: "Office Managers, Administrative Assistants, and 15 Elementary, Middle School, High School Office Assistants. Secretarial Excluded: Secretary to the 16 Superintendent, Secretary to the Deputy Superintendent, Secretary to the Associate Superintendents, 17 and Secretary to the Assistant Superintendents. Except as noted in Section , nothing within this 18 AGREEMENT pertains to employees not employed on a regular basis. 19 20 Section 21 Auburn AAEOP Office Assistants who were building paraeducators will have their Auburn 22 PSEA seniority grandfathered. 23 24 Section 25 Substitutes who work for ten (10) or more consecutive days in a position covered by this AGREEMENT 26 shall be paid the column A, step 1 wage rate for the work being performed unless they are a current 27 BARGAINING unit member.
7 If they are a current BARGAINING unit member, the employee shall receive the 28 higher pay rate for their substitute work as delineated in Section Substitutes shall not be subject to 29 any other conditions of this AGREEMENT . 30 31 Section Job Descriptions. 32 The district and the association will work collaboratively to assure all AAEOP job descriptions remain 33 updated. A committee shall be formed to review and, if needed, update all job descriptions before 34 March of the final year of this AGREEMENT . 35 36 Section Reclassification Requests. 37 Requests for employee reclassification should be written and forwarded to the Chapter President. 38 39 40 41 42 43 44 45 46 47 48 2016 - 2019 COLLECTIVE BARGAINING AGREEMENT Page 3 of 33 PSE of Auburn AAEOP/Auburn School District #408 September 1, 2016 A R T I C L E I I 1 2 RIGHTS OF THE EMPLOYER 3 4 Section 5 It is agreed that the statutory, customary and usual rights, powers, functions, and authority of 6 management are vested in management officials of the District.
8 Without in any way limiting the 7 generality of the foregoing, this will include rights in accordance with applicable laws and regulations 8 and the provisions of this AGREEMENT to direct the work force, the right to hire, promote, retain, 9 transfer, and assign employees in positions; the right to suspend, discharge, demote or take other 10 disciplinary action against employees; and the right to release employees from duties because of lack 11 of work or for other legitimate reasons. The District will retain the right to maintain efficiency of the 12 District operation by determining the methods, the means, and the personnel by which such operation 13 is conducted. 14 15 Section 16 The right to make reasonable rules and regulations shall be considered acknowledged functions of the 17 District.
9 In making such rules and regulations, the District shall give due regard to the rights of the 18 employees and to the obligations imposed by this AGREEMENT . 19 20 21 22 A R T I C L E I I I 23 24 RIGHTS OF EMPLOYEES 25 26 Section 27 It is agreed that the employees in the unit defined herein will have and will be protected in the exercise 28 of the right, freely and without fear of penalty or reprisal, to join and assist the Association. The 29 freedom of such employees to assist the Association will be recognized as extending to participation in 30 the management of the Association, including presentation of the views of the Association to the Board 31 of Directors of the District or any other governmental body, group or individual. The District will take 32 whatever action required or refrain from such action in order to assure employees that no interference, 33 restraint, coercion, or discrimination is allowed within the District to encourage or discourage 34 membership in any employee organization.
10 35 36 Section 37 Each employee will have the right to bring matters of personal concern to the attention of appropriate 38 Association representatives and/or appropriate officials of the District. 39 40 Section 41 Neither the District, nor the Association, shall unlawfully discriminate against any employee subject to 42 this AGREEMENT on the basis of race, creed, color, sex, national origin, age, marital status or because of 43 the presence of any sensory, mental or physical handicap with respect to a position, the duties of which 44 may be performed efficiently by an individual without danger to the health or safety of the 45 handicapped person or others, or in their exercise of their rights under Chapter RCW, Public 46 Employees' COLLECTIVE BARGAINING Act. Provided, however, should any provision of this AGREEMENT be 47 2016 - 2019 COLLECTIVE BARGAINING AGREEMENT Page 4 of 33 PSE of Auburn AAEOP/Auburn School District #408 September 1, 2016 in conflict with or inconsistent with the District affirmative action program such provision shall be 1 renegotiated pursuant to Section 2 3 Section 4 The Association agrees with and supports the concept of affirmative action.
