4 Instruct the EXECUTIVE Officer toadvertise for bids to be received and opened on December 22, 2008, inaccordance with the Instruction Sheet for Publishing Legal Authorize the Acting Director of Public Works to execute consultant servicesagreements with the apparent Lowest Responsive and Responsible Biddersto prepare baseline construction schedules for a $7,000 not-to-exceed fee,each funded by existing project funds and to establish the effective datesfollowing determination by the Acting Director of Public Works of the LowestResponsive and Responsible Delegate to the Acting Director of Public Works the authority to determine, inaccordance with the applicable contract and bid specifications, whether theapparent low bidders have timely prepared satisfactory baseline constructionschedules and satisfied all conditions for contract award, including the criteriaadopted by your Board for contract award.

5 Authorize the Acting Director ofPublic Works to award and execute the construction contracts, in the formpreviously approved by County Counsel, to the apparent Lowest Responsiveand Responsible Bidders and to establish the effective date of the contractsupon receipt by the Acting Director of Public Works of acceptablePerformance and Payment Bonds and evidence of required OF RECOMMENDED ACTIONA pproval of the recommended actions wil ensure compliance with the CaliforniaEnvironmental Quality Act (CEQA) process and authorize the Acting Director of PublicWorks to initiate development of modular living unit projects, which will be located onthe following Probation Department (Probation) facilities: Challenger Memorial YouthCenter and Camp Kenyon Scudder/Joseph Honorable Board of SupervisorsNovember 18, 2008 Page 3 Probation Officers assigned to the camps listed above are required to work five 8-hourshifts during their 56-hour stay at the camps.

6 Currently, Probation does not haveadequate sleeping quarters at these camps to accommodate existing personneL. Thislack of living space is further complicated by additional Probation Officers that are beinghired to work at these facilities. In some cases, OFFICE and gymnasium space arecurrently being used as sleeping quarters to meet this need. These improvements arenecessary to avoid further exacerbation of current crowded conditions. The proposedmodular living units will provide adequate staff living space needed and allow the officesand gymnasiums to be returned to their intended 3,600-square-foot modular unit consists of fourteen 100 square-foot rooms, four140 square-foot rooms, lunch area, men's and women's restrooms, janitor/water heaterroom, storage room and an electrical/telephone closet.

7 The proposed project alsoincludes utilty connections to support the new modular facilty ( water lines, electric,phone, low voltage). Although the modular units have similar amenities ( , sleepingrooms, lunch area, restroom, etc.), there are cost differences due to each facilty'sexisting site conditions and individual design order to expedite construction of the projects, it is further recommended that yourBoard authorize the Acting Director of Public Works to award and execute site workconstruction contracts to the apparent Lowest Responsive and Responsible Bidders (asdefined in the Facts and Provisions/Legal Requirements Section of this letter) if the lowbids are within the estimate of new construction cost ($216,000 and $328,000,respectively)

8 And contingent on those bidders completing. a baseline schedule thatconforms to the County 's specifications. If there are no bids that are within the estimateof new construction costs, we will return to your Board to reject all bids and recommendadditional actions for your of the recommended actions wil also authorize the execution of a consultantagreement with the apparent Lowest Responsive and Responsible Bidder (as defined inthe Facts and Provisions/Legal Requirements Section of this letter) to prepare baselineconstruction schedules that conform to the County 's schedule of baseline schedules is critical to successfully manage constructionactivities by the contractor and the County , and a responsible contractor must be able toproduce such a construction schedule.

9 Bid specifications provide that if the apparentlowest bidders fail to complete acceptable schedules, we may return to your Board torecommend that the bidders be determined nonresponsible and recommend awardingthe construction contract to the next lowest bidders, contingent on those bidderscompleting baseline schedules that conform to the County 's Honorable Board of SupervisorsNovember 18, 2008 Page 4 Sustainable Desh:in ProgramThe project wil support your Board's Sustainable Design Program by using waterefficient plumbing fixtures, energy effcient light fixtures with light sensor controls, andphotocells, which converts sunlight into electrical energy for outdoor lighting.

10 Utiltysavings are anticipated due to the reduction in electricity and water usage as a result ofthe sustainable elements included in the of Strategic Plan GoalsThese actions meet the County 's Strategic Plan Goals of Fiscal Responsibilty (Goal 4)and Organizational Effectiveness (Goal 3) by investing in infrastructure, which providesimproved employee working conditions and enhances the operation of the IMPACT/FINANCINGThe Department of Public Works' (Public Works) fair purchase order cost estimate,including contingency for the modular living unit procurement and installation, and sitework construction cost estimate is as follows for Challenger.
