You are considered an LQG ifyou generate more than 2,200 lbs(1,000 kg) of Hazardous Waste or morethan lbs (1 kg) of acute hazardouswaste per calendar month. 2 Be sure to check withyour state Hazardous Waste agency aswell, as some states have additional ormore stringent Requirements than thefederal must determine if any of thesolid wastes you generate are Hazardous so that you will be able tomanage, report, and track them properly. Hazardous wastes can be: nListed wastes willappear on one of four lists pub-lished in 40 CFR Part wastes. Certainwastes are considered Hazardous ifthey are ignitable, corrosive, reactive, or determine if your wastes exhibita characteristic, you may use EPA-approved test methods or apply yourknowledge of the Waste . If Waste is tobe land disposed, you must determineif your wastes exhibit any characteris-tics, even if they are listed the Land Disposal Restrictions(LDRs), most Hazardous wastes maynot be land disposed until they meet treatment standards. It is yourresponsibility to ensure that yourwaste is treated to these standards.

Be sureto measure wastes that are:nAccumulated on site for any timebefore disposal or directly into an on-site treatment or disposal as still bottoms orsludges and removed from product storage an EPAI dentification Number 40 CFR numbers are requiredfor persons that generate or man-age Hazardous Waste , including smalland Large Quantity Generators , trans-porters, and treatment, storage, anddisposal facilities. You will need anEPA identification number for eachsite that generates Hazardous find out where to call to obtainan identification number, contact theRCRA Hotline.

4 Once you have con-tacted the proper authority, you willbe sent EPA Form 8700-12,Notification of Regulated WasteActivity. Fill out the form and send itto the contact listed with the EPA identification number willbe returned to you for each HazardousWaste for Shipment Off Site 40 CFR must package, label, andmark your Waste containers andplacard vehicles that carry the wastes,following Department ofTransportation (DOT) HazardousMaterials Transportation Act require-ments (49 CFR Parts 172, 173, 178,and 179). Commercial Waste han-dlers can advise you on the properprocedure, but you remain responsi-ble for further information, call theDOT Hazardous MaterialsInformation Line at 202 a Manifest 40 CFR , Waste manifest mustaccompany all Hazardous wastethat is shipped off site. A manifest isa multipart form designed to trackhazardous Waste from the time itleaves the generation site until itreaches the TSDF specified on themanifest.

5 The manifest will help youto track your Waste during shipmentand make sure it arrives at the should use the manifest formfrom the destination state. If the destination state does not print themanifest form, then use one fromthe state of origin or another source,if the state of origin does not printthe manifest. The federal form is theUniform Hazardous Waste Manifest(EPA Form 8700-22). The trans-porter and the permitted facility thattreats or disposes of your Waste mustsign the manifest and send a copyback to 6/25/96 9:26 AM Page 4 Managing HazardousWaste On Site 40 CFR may accumulate any quantityof Waste in containers, tanks, drippads, and containment buildings for upto 90 days without a permit, providedthat you meet the technical standardsfor the containment unit. LQGs thatmeet all technical standards for haz-ardous Waste accumulation also maytreat the Waste without obtaining aRCRA permit.

6 Generators must clearlymark the date that accumulation beginson each container storing hazardouswaste so that it is visible for inspection. LQGs are also responsible forcomplying with preparedness andprevention Requirements in the eventof emergencies. In addition, you mustprepare a written contingency planand train employees on hazardouswaste management and your facility accumulates wastesfor more than 90 days, it is consid-ered a storage facility and must followregulations described in 40 CFR Parts264 and 270, unless you have beengranted an extension by your EPAR egional 40 CFR ReportingYou are responsible for submittinga Biennial Report to your EPAR egional Office. Reports submittedfor offsite shipping must include yourEPA identification number, informa-tion for the transporter and permittedfacility, a description and Quantity ofwaste, actions you have taken toreduce the volume and toxicity of thewaste, and the results of thoseactions.

7 These reports give EPA a better understanding of national Hazardous Waste generation and disposal. They can also be used topromote pollution prevention. Somestates might require you to you only export hazardouswastes, you are not required to submit a Biennial Report. You do,however, have to submit an annualreport (40 CFR ). Call theRCRA Hotline for more ReportingIf you do not receive a signed mani-fest from the final destination ofyour Hazardous Waste :nAfter 35 days, you must attemptto locate the Hazardous Waste bycontacting the permitted 45 days, you must submit toyour EPA Regional Office anException Report that contains acopy of the original manifest anda cover letter describing yourefforts to locate the shipment andthe results of your 6/25/96 9:26 AM Page 51 EPAU nited states environmental protection Agency401 M Street, SW. 8 The 3-year period is automaticallyextended during the course of anyunresolved enforcement with LandDisposal Restrictions 40 CFR Part 268 Wastes must meet certain treat-ment standards prior to landdisposal. When you transport yourwaste to a treatment facility, youmust send a notice informing thefacility that the Waste does not yetmeet treatment standards. The noticeshould contain enough informationabout the Waste and the applicablestandards so that the facility canmake sure that the appropriate stan-dards are met before disposal. Acertification is required in some situations. You can contact the RCRAH otline, your state agency , or EPAR egional office for help with notifica-tion and certification Requirements . Ifyou treat your Waste on site, youmust maintain a Waste analysis 40 CFR Part 262, Subpart E If you plan to export hazardouswastes, you will have to notify EPA60 days before the intended date ofshipment to obtain written , EPA s Acknowledgement ofConsent document, which is filledout by the receiving country, mustaccompany the shipment at all times.

9 Hazardous Waste managementfacilities receiving Waste from a for-eign source must notify the EPAR egional office of the shipment atleast four weeks before receiving of Hazardous Waste mustbe citizens and must certifythat the shipment is in compliancewith all applicable rules under theToxic Substances Control Act(TSCA).
