6 84:107 CHAPTER 84:10 LIQUOR LICENCES ACTAn Act to make provision in respect of the Sale of IntoxicatingLiquor and LICENCES in respect of the same.[22ND NOVEMBER 1955] Act may be cited as the LIQUOR LICENCES this Act authorised officer , in relation to any of the purposes of this Act,means a public officer designated in writing for the purposeby the Minister; beer includes ale, stout, porter, spruce beer, black beer, and anyother description of beer and any LIQUOR which is made orsold as a description of beer or as a substitute for beer, andwhich on analysis of a sample thereof at any time is foundto contain more than per cent ; company means a limited company registered in Trinidad andTobago under the Companies Act, but does not include anyCompany or association or persons calling themselves acompany not so registered; compounds means compounds made by a licensed compounderin accordance with the Spirits and Spirit Compounds Act; Comptroller means the Comptroller of Customs and Excise ; deal and dealer mean the trade of selling intoxicating liquorfor consumption off the licensed premises in not less thanthe quantity prescribed in each case, and the person carryingon such trade, respectively.

7 Excise Act means this or any other Excise Act, or anyregulation, having the force of law, for the time being inforce, relating to intoxicating LIQUOR ;27 of [6 of 1991].Ch. 81 87 OF LEGAL TO DECEMBER 31ST 2007 LAWS OF TRINIDAD AND TOBAGO8 Chap. 84:10 LIQUOR LICENCES foreign liqueurs means spirits flavoured or sweetened, andimported into Trinidad and Tobago, by whatever name thesame are sold; hotel means any building or group of buildings (occupiedtogether) for the accommodation for reward of personslodging or taking meals therein and includes the curtilagethereof and all structures within such curtilage, containingnot less than six bedrooms; house and premises include every room and place under thesame roof or within the same curtilage, occupied with or asappurtenant to any house, premises, room or place.

8 Intoxicating LIQUOR means spirits, wine or beer, or any liquorbeing a mixture, beverage or preparation containing the same; licence means any licence granted under this Act; licensed (as regards persons or premises) means the personsnamed or whose names are endorsed on a licence issuedunder this Act and the premises in which a trade is licensedto be carried on under this Act; licensing area means a part of a licensing district appointed bythe Licensing Committee of the district to be a licensing areafor the purposes of this Act; licensing committee means a committee constituted undersection 5; licensing district means a district constituted under section 4; Licensing Sessions means the Sessions held under section 18for the granting of LICENCES and any adjournment ofsuch Sessions; Magistrate means the Magistrate for the district within whichthe licensed premises are situated, or, as the case may be,within which any offence is charged to have been committed; occupier means the person in actual occupation of a house orpremises as master of the same or of the trade or businesstherein carried on.

9 Officer means the Comptroller, any member of the PoliceService and any person acting under the instructions of theComptroller for the purposes of any Excise Act;MINISTRY OF LEGAL TO DECEMBER 31ST 1/2006 LAWS OF TRINIDAD AND TOBAGOL iquor LicencesChap. 84:109 permit means a permit required for the removal of spirits underthe Spirits and Spirit Compounds Act; Port-of-Spain means the City of Port-of-Spain as defined fromtime to time under the Municipal Corporations Act; renewal means a renewal of a licence that has been in force inrespect of the same premises and in favour of the sameperson up to the day on which such renewal commences; retail and retailer means the trade of selling intoxicating liquorfor consumption on or off the licensed premises withoutrestriction as to quantity, and the person carrying on suchtrade, respectively; sale and sell include barter and exchange.

10 San Fernando means the City of San Fernando as defined fromtime to time under the City of San Fernando Act; Scarborough means the town of Scarborough in Tobago asdefined from time to time under the Public Health Ordinance; spirits means any LIQUOR containing alcohol the product ofdistillation, and includes any LIQUOR sold or offered for saleas or as containing rum, whisky, gin or any other descriptionof spirits; and this term also includes for the purposes ofthis Act all beverages whether purporting to be wine, beeror other fermented liquors or not, containing a greaterproportion than per cent either due tofermentation or added; steamship means a ship propelled by steam or any motor power; tourist steamship means any steamship notified as a touriststeamship by the Comptroller for the period stated insuch notice; town means the several places specified in the First Schedule,and every other place declared to be a town for the purposeof this Act by the President.
