6 Future Course of Action of Preparedness for Emergency 5. 1. Background Disaster relief activities in Nepal are carried out being based on the Disaster Relief Act 1982. This National Disaster Response Framework is prepared to implement and coordinate a Response plan of National level Disaster by ensuring all the elements of Disaster management cycle and allocate appropriate role for governmental and no- governmental organizations. 2. Objectives and Scope 1. The purpose of this Framework is to guide more effective and coordinated National Response in case of a large scale Disaster . 2. The scope of this Framework consists actions taken immediately before, during and after the disasters, or directly to save lives and property; maintain of law and order; care of sick, injured and vulnerable people; and provide of essential services and protect the public property.

7 3. The scope of this Framework is limited to the Response preparedness and emergency Response at National , regional, district and local level. 3. National System for Disaster Response 1. Disaster Relief Act 1982 and Local Self Governance Act 1999 are the basic current legal provisions for Disaster Response in Nepal. 2. Natural Calamity Relief Act 1982 mandated the Ministry of Home Affairs as a lead agency for immediate rescue and relief works as well as Disaster preparedness activities. According to Nepal Government's Regulation for Roles Division 2007, MoHA is entirely responsible for Disaster management. Hence, the MoHA has been coordinating the activities of Disaster preparedness and rehabilitation after Disaster .

8 3. The National strategy for Disaster risk management is formulated in 2009 to develop Nepal as a Disaster -resilient country. 4. The Cabinet shall declare, based on the recommendation of the Central Disaster Relief Committee, the state of emergency when the area is affected by the natural calamity and beyond the capacity of Government of Nepal (GoN). The government shall appeal for international assistance. 5. The Disaster fund for emergency Response is channelized from the Natural Calamity Relief Fund at central, regional, district and local level. Prime Minister Relief Fund and Emergency Fund are also mobilized for Disaster Response during emergency.

9 In addition, the Disaster funds are allocated by international and National humanitarian communities for Disaster Response . Considering the context of both of the above funds shall be mobilized, establishment of funds for central, 6. regional, district and local level Disaster Response have been realized. 6. The formation of Central Natural Disaster Relief Committee (CNDRC), Regional Disaster Relief Committee (RDRC), District Disaster Relief Committee (DDRC). and Local Disaster Relief Committee (LDRC) based on Natural Calamity Relief Act 1982 for the overall Disaster Response in Nepal. Additionally, supply, shelter and rehabilitation, relief and treatment sub-committees shall be established.

10 Emergency operation centers are functional at National , regional, district and municipal level for information collection on Disaster management, analysis, flow and coordination. 7. According to provision of Local Self Governance Act 1999, local authorities (DDC, VDC and Municipality) are playing roles of Disaster preparedness and Response . 4. International Assistance for Disaster Response 1. If required, the Government of Nepal may request to UN Humanitarian Coordinator, international governments, Red Cross Movement, regional organizations, donor communities, I/NGOs, international professional organizations, non-resident Nepalese for international assistance in cash or kind or services to respond to Disaster .
