2 Therefore, thisAPHIS Permit for the commodity to be imported does not reduce or eliminate the permittee's legal duty andresponsibility to likewise comply with all other Federal and State regulatory requirements applicable to thecommodity to be importer or designee is responsible for confirming with CBP and PPQ at the destination port in advance of eachshipment, that CBP and PPQ has the capacity to clear or handle permitted air and maritime cargo shipments,including bulk, mail, and express consignment shipmentsThe applicant for a Permit for the importation of regulated articles into the United States must designate the personwho will be named as the permittee upon the permits issuance.

3 The applicant and the permittee may be the sameperson or different persons and the submission of this form affirms that the applicant is at least 18 years of permittee is the legal importer of an article and is responsible for complying with the Permit conditions. Thepermittee must be at least 18 years of age and have and maintain an address in the United States that is specified onthe Permit and be physically present during normal business hours at that address during any periods when articlesare being imported or moved interstate under the Permit ; or If another legal entity, maintain an address or businessoffice in the United States with a designated individual for service of process; and serve as the contact for thepurpose of communications associated with the movement of the regulated article for the duration of the Permit .

5 Please refer to the USDA-PPQ Port Program Manuals for the current Import requirements forthe commodities you are the official personnel find that the shipment requires treatment as a condition of entry, is contaminated with aquarantine Plant pest or pests, is commingled with a prohibited Plant material, or if required documentation isincomplete or missing, they will order the least drastic action, which could be approve treatment, re-exportation ordestruction of a shipment, a portion of a shipment, or any other material associated with the shipment ( pallets,packaging, means of conveyance) Noncompliant shipments will be treated, re-exported or destroyed, at theconsignee's person who violates the Plant Protection Act (PPA) of the United States, individuals or corporations who fail tocomply with these conditions and authorizations, or who forge, counterfeit, or deface permits may be criminally oradministratively prosecuted and found guilty of a misdemeanor which can result in penalties, a one-year prison term,or both.

6 In addition, all current permits may be cancelled and future Permit applications shipment must be free from soil(unless authorized), Plant material other than seed, other foreign matter or debris,seeds in the fruit or seed pod; and living organisms such as parasitic Plants , pathogens, insects, snails, and fumigation is required, and plastic wrappings such as cellophane, films, and shrink wrap; and papers that arewaxed, laminated, or waterproofed are used for wrapping must be perforated, removed, or opened before wrappings are perforated to facilitate fumigation, holes should be at least 3/16-inch in diameter every 3 squareinches or 1/4-inch in diameter every 4 inches over the entire surface of the wrapping.

7 1. Under the Plant Protection Act, individuals or corporations who fail to comply with the following conditions andauthorizations, or who forge, counterfeit, or deface permits or shipping labels may receive civil or criminal penalties,and may have all current permits cancelled and future Permit applications denied. Additionally, the permittee isresponsible for ensuring that Plant materials imported under this Permit comply with all applicable requirementsstated in Title 7 Code of Federal Regulations Part 2. Promptly upon arrival of any restricted article at a port of entry, the importer shall notify the Plant Protection andQuarantine Programs of the arrival by such means as a manifest, Customs entry document, commercial invoice,waybill, a broker's document, or a notice form provided for that purpose (PPQ form 368) which is available at thefollowing website: #ppq.

8 3. A phytosanitary certificate must accompany all propagative material imported under this Permit . 4. A typed or legibly printed list/invoice must accompany each shipment, and must include the name of thecollector/shipper, the botanical names (genus and species) listed alphabetically, as well as the country of origin, andcountry shipped from, for each taxon. 5. If you are commercially importing, exporting or reexporting CITES (Convention on International Trade inEndangered Species) regulated Plant material you must obtain a USDA Protected Plant Permit in addition to thispermit. You can find a listing of CITES protected Plants at this website: documentation must be obtained prior to importation and must accompany the shipment.

9 6. The shipment must be free from soil, other foreign matter or debris, prohibited Plants , noxious weed seeds, andliving organisms such as parasitic Plants , pathogens, insects, snails, and mites. Material found to be commingled withprohibited or infested material will be subject to the same action ( re-export, destruction, ) as the prohibited orinfested material. 7. The permittee must instruct the supplier to label each container with the genus and species name of Plants containers holding more than one species, each species must be labeled separately.
