4 9th October, by parliament and assented to by the President:PARTONE COMMUNICABLEDISEASESA pplication of this Part to other diseases1.(1) The Minister shall, by executive instrument, declare that adisease is communicable, infectious or contagious in nature.(2) Where an instrument is published declaring a disease as com-municable, infectious or contagious the provisions of this Part shall apply.(3)For the purposes of this Part, and of any other enactment, com-municable disease includes a disease of a communicable, infectious orcontagious nature which is declared by the Minister as a Health Act, 2012 Act851 Declaration of infected area, order for evacuation2.(1)The Minister(a)shall, by executive instrument, declare a clearly defined areain which a communicable disease has occurred as an infectedarea, and(b)may by the same or a subsequent instrument order theevacuation of the whole or a part of the infected area.

5 (2)The order for evacuation may apply to all persons or to a personor a class of persons specified in the instrument.(3)A person shall not reside, enter or carry on business within aninfected area or a part of an infected area in contravention of an orderfor evacuation, except under an order in writing to that effect signed by amedical officer and on the conditions specified by the medical officer.(4)Subsection (3) does not apply to a person passing along a thorough-fare which is allowed to remain open to the Public .(5) A person who contravenes subsection (3) commits an offenceand is liable,(a)for a first offence, to a fine of not more than fifty penaltyunits or to a term of imprisonment of not more than threemonths, or to both; and(b)for a second or subsequent offence, to a term of imprison-ment of not more than six months, or to both the fine andthe of vehicles3.

6 (1) A medical officer, a veterinary officer, an environmental healthofficer, a police officer, or any other person designated by the Minister,may for the purpose of medical examination,(a)stop a vehicle travelling in, or suspected to be travelling in ortravelling to or from an infected area, and(b)detain any of the persons travelling or being conveyed in oron the vehicle.(2)A person suffering or suspected to be suffering from a communi-cable disease, or a corpse, or an article suspected to be capable of spreadinginfection may be removed from the vehicle and dealt with as prescribedby the Regulations made by the Health Act, 201210 Act851(3) The driver of a vehicle who refuses or fails to stop when asked todo so by any of the persons mentioned in subsection (1), commits anoffence and is liable on summary conviction to a fine of not more thanfifty penalty units or to a term of imprisonment of not more than threemonths, or to within an infected area4.

7 (1)A person licensed to sell in a store situated in an infected area ora part of an infected area which is included in an order for evacuation, isentitled(a)to a transfer of the licence to a store situated in a place towhich the order for evacuation does not extend, and(b)to a refund of the whole or a part of the fee paid for the licence,or as may be awarded by a Compensation Board estab-lished under section 12.(2)Subsection (1) applies to a food vendor or a person who sellswater or mortem a medical officer, a veterinary officer or an authorised healthofficer suspects that a person has died of a communicable disease whetherin an infected area or not, the medical officer, veterinary officer or theauthorised Health officer shall order that the body of the deceased person beconveyed to a specified place for an examination that the medical officer,veterinary officer or the authorised Health officerrs considers (1)A medical officer, veterinary officer or any other authorisedhealth officer may place, or cause to be placed, on a house, structure or atan area where a case of a communicable disease has occurred, whetherin an infected area or not, a marking denoting the occurrence of thedisease as prescribed by Regulations.

8 (2)The mark shall be kept affixed for a period that the medicalofficer or veterinary officer or any other authorised Health officer considersnecessary.(3)A person who unlawfully removes or obliterates the markcommits an offence and is liable on summary conviction to a fine of notmore than one hundred penalty units or to a term of imprisonment ofnot more than six months or to Health Act, medical officer, veterinary officer or an authorised Health officermay order the disinfection(a)of a house, structure or an area in which a case or suspectedcase of a communicable disease has occurred, whether inan infected area or not, and(b)of property belonging to a person residing or being in thathouse, structure or of buildings8.(1) A District Assembly shall by an order of the Court cause thedestruction of a house or structure whether in an infected area or not,where a case of a communicable disease has occurred and of anything inthat house or building, or elsewhere which a medical officer, veterinaryofficer or an authorised Health officer considers necessary in the interestof Public Health .

9 (2)The order shall be carried out in the manner and by the persondirected by the District Assembly.(3)A claim for compensation in respect of the destruction of ahouse, building, or any other thing under this section shall be determinedby a Compensation of animals9.(1) A veterinary officer, or an authorised Health officer may orderthe destruction of an animal whether or not the animal is in an infectedarea if the officer is satisfied that the animal is likely to be an agent in thetransmission of a communicable disease.(2)A veterinary officer, or an authorised Health officer may disposeof the carcass of an animal destroyed in the manner specified by theofficer.(3)A claim for compensation for an animal destroyed shall bedetermined by the Compensation and detention of infected persons or disposal of corpse10. (1)A medical officer or an authorised Health officer may(a)cause a person suffering or suspected to be suffering from acommunicable disease, whether in an infected area or not,to be removed to a Health facility or designated place; and(b)detain that person until the medical officer or Health officerdetermines that that person is safe to be Health Act, 201212 Act851(2) A medical officer or an authorised Health officer may(a)determine the manner in which the remains of a deceasedperson is to be disposed of.

10 Or(b)authorise the disposal of the remains of a deceased personin a specified mannerwhether or not the deceased person is in an infected area if the medicalofficer or authorised Health officer is satisfied or has reason to believethat the remains of the deceased peron is likely to be an agent in thetransmission of a communicable of contacts11.(1)A medical officer may order a person living in the same houseor compound, or a person who has come into contact with another per-son suffering or suspected to be suffering from a communicable disease,whether in an infected area or not, to be isolated in a designated placeprovided by the Government until that person is considered safe to bedischarged.(2)A person authorised by the medical officer to carry out an orderunder subsection (1) may use reasonable force to compel that person toobey the Board12.
