2 (d)AAEachcivicstrainingprogramdevelopedu nderSubsection(a) mustbe reviewedand approvedby the StateBoardof boardshallannuallyrevieweachprogram.(e)A AEachschooldistrictand open-enrollmentcharterschoolshallensuret hateachdistrictor schoolcampusthatoffersa gradeleveldescribedby Subsection(c) has at leastone teacherand oneprincipalor campusinstructionalleaderwho has attendeda schooldistrictsand open-enrollmentcharterschoolsin complyingwiththerequirementsof thissubsection.(f)AAFromfundsavailablefo rthatpurpose,a teacherwhoattendsa civicstrainingprogrammay receivea stipendin an amountdeterminedby stipendreceivedunderthissectionis not includedin determiningwhethera districtis payingthe teacherthe (g)AAThe commissionermay delayimplementationof Subsection(e) to a schoolyearnot laterthanthe 2025-2026schoolyearif therevisionof (h-2)or the availabilityofcivicstrainingprogramsdoes not occurin a mannerthatreasonablyaffordspublicschools the abilityto complywiththatsubsectionby an , (h-2),EducationCode,as ,Actsof the 87thLegislature,RegularSession,2021,and effectiveSeptember1, 2021,is amendedto readas follows:(h-2)AAIn adoptingthe essentialknowledgeand skillsfor thesocialstudiescurriculumforeachgradele velfromkindergartenthroughgrade12,theSta teBoardof Educationshalladoptessentialknowledgeand skillsthatdevelopeachstudent s civicknowledge,including:(1)AAan understandingof.

6 ,EducationCode,as effectiveSeptember1, 2021,is amendedby amendingSubsections(h-3)and(h-4)and addingSubsections(h-6)and (h-7)to readas follows:(h-3)AAFor any socialstudiescourseor subject,includinganinnovativecourse,fora gradelevelfromkindergartenthroughgrade12 [in the requiredcurriculum]:(1)AAa teachermaynotbe compelledto discussaparticularcurrenteventorwidelyde batedandcurrentlycontroversialissueof publicpolicyor socialaffairs;(2)AAa teacherwho choosesto discussa topicdescribedby Subdivision(1)shall,to thebestof theteacher s ability, explorethat[the]topicfromdiverseandconte ndingperspectiveswithoutgivingdeferencet o any one perspective;(3)AAa schooldistrict,open-enrollmentchartersch ool,or teachermay not require,makepartof a course,or awarda gradeor coursecredit,includingextracredit,for a student s:(A)AAworkfor,affiliationwith,or servicelearningin associationwithany organizationengagedin:(i)AAlobbyingforle gislationatthefederal,state,or locallevel;or(ii)AAsocialpolicyadvocacyo rpublicpolicyadvocacy;(B)AApoliticalacti vism,lobbying,or effortstopersuademembersof thelegislativeor executivebranchat thefederal,state,or locallevelto takespecificactionsby directcommunication;or(C)A[(B)]AApartici pationinanyinternship,practicum,or similaractivityinvolvingsocialpolicyadvo cacyorpublicpolicyadvocacy.
7 And(4)AAa teacher,administrator,or otheremployeeof astateagency,schooldistrict,or open-enrollmentcharterschoolmay not:(A)AArequire,or makepartof a course,conceptsthatserveto inculcate[berequiredto engagein training,orientation,or therapythatpresentsanyformof raceor sexstereotypingor blameon the basisof raceor sex];(B)AAteach,instruct,or trainany administrator,teacher,or staffmemberof a stateagency,schooldistrict, adopt[requireor makepartof acourse]the conceptthat:(i)AAone raceor sex is inherentlysuperiorto anotherraceor sex;(ii)AAanindividual,byvirtueoftheindi vidual s raceor sex,is inherentlyracist,sexist,oroppressive,whe therconsciouslyor unconsciously;(iii)AAan individualshouldbe discriminatedagainstor receiveadversetreatmentsolelyor partlybecauseofthe individual s raceor sex;(iv)AA[membersof one raceor sex cannotandshouldnot attemptto treatotherswithoutrespectto raceor sex;[(v)]AAanindividual s moralcharacter,standing,or worthis necessarilydeterminedby theindividual sraceor sex;(v)A[(vi)]AAan individual,by virtueof theindividual s raceor sex,bearsresponsibilityforactionscommitt edin the pastby othermembersof the sameraceor sex;(vi)A[(vii)]AAanindividualshouldfeel discomfort,guilt,anguish,or anyotherformof psychologicaldistresson accountof the individual s raceor sex;(vii)A[(viii)]AAmeritocracyor traitssuchas a hardworkethicare racistor sexistor werecreatedby membersof a particularraceto oppressmembersof anotherrace;(viii)A[(ix)]AAthe adventof slaveryin theterritorythatis nowtheUnitedStatesconstitutedthetruefoun dingof the UnitedStates; (ix)A[(x)]AAwithrespecttotheirrelationsh ipto Americanvalues,slaveryandracismareanythi ngotherthandeviationsfrom,betrayalsof, or failuresto liveup to,theauthenticfoundingprinciplesof theUnitedStates,whichincludelibertyand equality;and(C)AArequirean understandingof The 1619 Project.]
8 (h-4)AAA stateagency,schooldistrict,or open-enrollmentcharterschoolmaynotaccept privatefundingforthepurposeofdevelopinga curriculum,purchasingor selectingcurriculummaterials,orproviding teachertrainingorprofessionaldevelopment fora coursedescribedby Subsections[Subsection](h-3)(3)and (4).(h-6)AASubsection(h-3)(3)may not be construedto applyto astudent s participationin communitycharitableprojects,suchasbuildi ngcommunitygardens,volunteeringat localfoodbanks,orotherserviceprojects.(h -7)AAThe agencyshallensurethateachschooldistricto ropen-enrollmentcharterschoolteachescivi cseducationas partofthedistrict s socialstudiescurriculumin a mannerconsistentwiththeessentialknowledg eandskillsadoptedunderSubsection(h-2). (h-2),EducationCode,as ,Actsof the 87thLegislature,2021,is redesignatedas (h-8),EducationCode,to readas follows:(h-8)A[(h-2)]AAInprovidinginstru ctionregardingthefoundingdocumentsof the UnitedStatesas describedby Subsection(h-1)(4),a schooldistrictor thosedocumentsas partof the instructionalmaterialsfor (a)Exceptas providedby Subsection(b) of thissection,thisAct appliesbeginningwiththe 2021-2022schoolyear.
9 (b) (h-2),EducationCode,as addedby ,Actsof the87thLegislature,RegularSession,2021,e ffectiveSeptember1, 2021,andas amendedby thisAct,appliesbeginningwiththe laterthanDecember31, 2022,the StateBoardof Educationshallreviewandrevise,as needed,theessentialknowledgeand skillsof the socialstudiescurriculumas requiredby (h-2),EducationCode,as addedby ,Actsof the87thLegislature,RegularSession,2021,e ffectiveSeptember1, 2021,and as amendedby any provisionof thisAct or its applicationto any personor circumstanceis heldinvalid,the invaliditydoesnot affectotherprovisionsor applicationsof thisAct thatcan begiveneffectwithoutthe invalidprovisionor application,and tothisend the provisionsof thisAct are declaredto be , 2021,if itreceivesa voteof two-thirdsof allthememberselectedto eachhouse,as providedby Section39, ArticleIII, thisAct doesnot receivethe votenecessaryfor effecton thatday,thisAct takeseffecton the 91stday afterthe lastday of
