1 SchemeforFacilitatingStartupsIntellectua lPropertyProtection( sipp )IntroductionInt ellectualPropertyRights(IPRs)areemerging as a strategicbusinesstoolfor anybusinessorganizationto ,withlimitedresourcesand manpower,cansustainin thishighlycompetitiveworldonlythroughcon tinuousgrowthanddevelopmentorientedinnov ations;for this,it is schemefor StartupsIntellectualPropertyProtection(S IPP)is envisagedto facilitateprotectionof Patents,TrademarkandDesignsofinnovativea nd Schemewas run on a pilotbasisinitially,and wasin forceup to schemeis nowbeingextendedfurtherfor a periodof ,basedon theexperiencegainedfromimplementationof the schemeso far.

2 Certainaspectsof the protectandpromoteIntellectualPropertyRig htsof sipp aimsto promoteawarenessandadoptionof inclinedto nurtureandmentorinnovativeandemergingtec hnologiesamongStartupsandassistthemin protectingandcommercializeit by providingthemaccessto high-qualityIP servicesand termsof the notificationGSR180(E)publishedin the PartII, Section3, SubSection(i)of the Gazetteof ,as maybe amendedfromtimeto Recognitiongivenby DIPP maybe startupscoveredunderthis schemewill not be requiredto obtaincertificateof an eligiblebusinessfromthe Inter-MinisterialBoardof ,startupswill be requiredto givea self-declarationthattheyhavenot availedfundsunderanyotherGovernmentschem efor the purposeof payingthe facilitator/patentagent/trademarkagentfo rfilingand prosecutingtheirIP effectiveimplementationof the Scheme ,facilitatorsshallbe empanelledby the ControllerGeneralof Patent.

3 Trademarkand Design(CGPDTM).The CGPDTM mayrevisethe list of ,it is to be clarifiedthatthe IP applicationhas to be signedby a personauthorizedto doso underthe provisionsof the relevantAct and CGPDTM shallregulateconductand functionsof empanelledfacilitatorsfromtimeto caseof any complaintby a startupabouta facilitatoror refusalby facilitatorto provideservicesto the startupor on gettinginformationaboutprofessionalmisco nductthroughany source,the CGPDTMcan removethe facilitatorfromthe PatentAgentregisteredwiththe TrademarkAgentregisteredwiththe Advocateas definedunderThe AdvocatesAct,1961whois entitledto practicelaw as perthe ruleslaiddownby Bar Councilof Indiafromtimeto time,whois well-versedwiththeprovisionsof therelevantActsandRules,andis activelyinvolvedin filinganddisposalofapplicationsfor governmentdepartment/organization/agency or CPSU(likeTIFAC,NRDC,BIRAC,MeitY,CSIRetc. )

4 Throughan maybe decidedby the CGPDTM,facilitatorswill be responsiblefor:>- Providinggeneraladvisoryon differentintellectualpropertyrightsto startupson pro bonobasis,>- Providinginformationon protectingand promotingIPRsto startupsin othercountrieson probonobasis,>- Providingassistancein filingand disposalof the IP applicationsrelatedto patents,trademarksandDesignunderrelevant Actsat thenationalIP officesunderthe CGPDTM>- Draftingprovisionaland completepatentspecificationsfor inventionsof Startups ,>- Preparingand filingresponsesto examinationreportsand otherqueries.

5 Noticesor lettersbythe IP office,>- Appearingon behalfof startupat hearings,as maybe scheduled,>- Contestingopposition,if any,by otherparties,and>- Ensuringfinaldisposalof the schemeshallbe applicablefor a periodof 3 be applicableto the empanelledfacilitators,for anynumberof patents,trademarksor designsthatmaybe appliedfor by a chargeanything(Figuresin Rs.)..fromthe Startupor the entrepreneur,and this feesshallbe paiddirectlyto the facilitatorby the CentralGovernmentthroughthe officeof the CGPDTMand disbursedby the respectiveIP revisedfromtimeto timeby the Departmentof IndustrialPolicyand the timeof filingof Application10,0002,0002,000At the timeof finalWithoutOpposition10,0002,0002,000di sposalof ApplicationWithOpposition15,0004,0004,00 0 NotesforPaymentofFeestofacilitators:~A facilitatorshallclaimthe fee fromthe IP office-asper the stageof workcompleted.

6 ~Thebill for claimof fee shallbe accompaniedby the self-declarationfromthe concernedstartupthatit has not availedof fundsfromany otherGovernmentschemefor the purposeof payingthefacilitator/patentagent/tradema rkagentfor filingand prosecutingtheirIP application.~If any applicationis withdrawnor abandonedbeforedisposalof application,facilitatorshallbeentitledto feesonlyfor filingof applicationand not for disposalof application.~For claimingthe reimbursementof fees,the facilitatorshallsubmitan invoiceto the respectiveIPOfficementioningthe Registration10 No.

7 ObtainedfromDIPPfor the startupin respectof whichthe IP applicationis filedby the facilitator.~In the caseof a Trademarkapplication,finaldisposalof the applicationimpliesregistrationof theTrademarkor finalrejectionof the application(exceptthroughwithdrawalor abandonment),asthe costof the statutoryfeespayablefor eachpatent,trademarkor designappliedfor by a startupafterlaunchof this schemeshallbe borneby the budgetfor the schemeshallbe providedfromthe fundsavailablewiththe no waytransfer,eitherwhollyor partially,ownershiprightson the IPR createdtothe facilitatoror the Government,and the Startupshallhavefull rightson the IP schemedoesnot in any wayentitlethe startupor the facilitatorto grantor registration,as the casemaybe,of the IPR.

8 The applicationsshallbe disposedoff as per the relevantlawsand rules.**
