4 No faxed or e mailed application forms will be accepted. 2 That no natural person/ individual who is not18years old on the date of sale will be allowed to purchase a stand . 3 Each of aforementioned natural persons/individuals will then be invited to purchase the available stands, by way of a draw of numbers. 4 That the stands shall first be sold to individuals or natural persons who have never owned/acquired/been allocated immovable propertybefore,namelythe first category. 5 That should there be standsavailable after the sale of standstothe first category, the available standsbe sold to the second category [to persons who do not own/acquired any immovable residential property at the time of submitting the application, but have before owned/acquired/been allocated immovable property] and thereafter to the third category [to persons who own immovable residential property at the time of submitting the application], if the stands are still available, on the same terms and conditions as the first category.

5 6 That only applicants with pre approved finance documentation and those who can provide documentary proof that they have funds available to purchase and build on the stands be invited to the actual sale of stands. 7 That the available stands be sold in cash on the date of 8 That only a single erf may be sold per individual/natural person with the understanding that couples marriedmayonly purchase a single erf. 9 No options to purchase be allowed. 10 That the erf may not be sold for a period of 36 months from the date of sale unless it has been fully developed an occupational certificate issued. 11 That the property shall be fully developed in accordance with approved building plans within 24 months from the date of sale unless the extension of time has been granted by the Council.

6 12 Under no circumstances will the erf be sold by the purchaser before the Council s prior written permission is obtained. 13 That an account for the rendering of municipal services shall only be opened in the name of the purchaser and shall remain in his/her name for a period of 3 years unless the permission for the sale of the property has been granted by the Council. 14 That the Council be granted an option to re purchase the property at the original price with or without improvements if the purchaser is unable to comply with the 24 months development period or wishes to sell the property within 36 months. 15 That the erven be sold only to persons who have submitted the application forms and have qualified to be invited to the actual sale of stands.

7 16 That 40% of the erven be reserved for the previously disadvantaged communities. 17 Transfer shall be passed by the Seller s Attorneys within 180 days after signing of the Deed of Sale. All costs shall be borne by the purchasers ondemand of the transferring attorneys. Full particulars of the proposed sale are available atthe Department of the Town Secretary, Room C301, Second Floor, Municipal Building, Corner of Wanderers and Kerk Streets, Middelburg on Monday to Thursday between 08:00 and 12:30 and between 14:00 and 16:00 and on Friday between 08:00 and 13:00 from 19 th January 2009 until13 th February 2009. Any person who wishes to object to the proposed sale must lodge such objection in writing together with the reasons to the Municipal Manager, Municipal Building, Corner of Wanderers and Kerk Streets, Middelburg or by post at P O Box 14, Middelburg, 1050 before or on13 th February 2009at 12:00.
