4 -This SUBCHAPTER shallestablish the minimum safety requirements for, andcontrol the design, construction, installation, alteration,and use of CHIMNEYS and gas VENTS . [ ] 27-850 The provisions ofreference standard RS-15 shall be a part of this SUBCHAPTER . [ ] 27-851 Definitions. -For definitions to beused in the interpretation of this SUBCHAPTER , seesubchapter two of this chapter. [ ] 27-852 Plans. -For the requirements governingthe filing of plans and the work to be shown on plans,see SUBCHAPTER one of this chapter. [ ] 27-853 Permits. -For the requirementsgoverning equipment work permits and equipment usepermits, see SUBCHAPTER one of this chapter. [ ] 27-854 General requirements. Chimneysor gas VENTS shall be designed and constructed so as toprovide the necessary draft and capacity to completelyexhaust the products of combustion to the outside air,and to satisfy the following conditions:(a) Temperature.

5 -The temperature on adjacent combustiblesurfaces shall not be raised above one hundred sixtydegrees Fahrenheit.(b) Condensation. -The condensation shall not be developedto an extent that can cause rapid deterioration of chimneyor vent.* [ ] 27-855 Factory-built CHIMNEYS and gas (a) Factory-built CHIMNEYS . -Factory-built chimneysand chimney units shall be listed and accepted inaccordance with the applicable reference standard andshall be installed in accordance with the temperatureconditions and height limitations of the listing andacceptance, the manufacturer's instructions or this article,whichever is the most restrictive. Flue gas temperaturesin the chimney shall not exceed the limits and durationsemployed during listing tests and as required by this code.(b) Gas VENTS . -Type B and Type BW gas VENTS shall belisted and accepted in accordance with the conditions ofthe acceptance and applicable provisions of this code.

6 *Local Law 2 CHIMNEYS [ ] 27-856 General requirements. -(a) Equipment requiring All gas-burningequipment that produces flue gas temperatures in excess offive hundred fifty degrees Fahrenheit or four hundred eightydegrees Fahrenheit above room temperature, and all solidand liquid fuel-burning equipment, shall be connected tochimneys that conform to the requirements of this SUBCHAPTER .*(b) Chimney construction. -Unlisted CHIMNEYS shall beconstructed of steel, brick, masonry units, concrete,concrete units, or equivalent materials. CHIMNEYS shall beof adequate structural strength, with resistance suitable forthe temperatures to which they may be subjected andresistive to the corrosive action of gases. For structuralrequirements, see subchapters ten and eleven of this chapter.(c) Separation of flues. -Whenever more than one flueis installed within a chimney, the lining of each flueshall be separated, one from the other, as follows:(1) In low temperature CHIMNEYS with fire clay fluelinings: by a wythe of cement grout at least one inchthick or other equivalent method.

7 (2) In medium temperature and high temperature CHIMNEYS :by a division wall of brick or concrete at least three andthree-quarters inches thick or other equivalent separation between flue linings thus established shallin all cases be adequate to give stability for the chimneyconstruction as required by SUBCHAPTER ten of this article.(d) Test run. -All new CHIMNEYS shall be test run by theapplicant under operating conditions to demonstrate firesafety and the complete exhausting of smoke and theproducts of combustion to the outer air. The results of suchtest run shall be certified as correct by the applicant andshall be submitted in writing to the department.(e) Requirement of a smoke test. -Whenever requiredby the commissioner after an inspection has been madeof the chimney, a smoke test shall be made as outlinedin section 27-868 of this article. Any faults or leaksfound shall be corrected. Such smoke test shall bewitnessed by a representative of the commissioner.

8 Inlieu thereof, the commissioner may accept the testreport of an architect or engineer in which case the testshall be subject to the provisions for **controller inspectionexcept that the architect or engineer may be retained bythe contractor.*Local Law 80-1989.**As enacted but controlled probably intended . [ ] 27-857 Classification of shall be classified as follows:(a) Low temperature CHIMNEYS . - CHIMNEYS designedand constructed to exhaust the products of combustionfrom low temperature equipment as defined in subchapterfourteen of this chapter.(b) Medium temperature Chimneysdesigned and constructed to exhaust the products ofcombustion from medium temperature equipment asdefined in SUBCHAPTER fourteen of this chapter.(c) High temperature CHIMNEYS . - CHIMNEYS designedand constructed to exhaust the products of combustionfrom high temperature equipment as defined in subchapterfourteen of this chapter. [ ] 27-858 Cleanouts and a new chimney is completed or an existingchimney is altered, it shall be cleaned and left smoothon the inside.

9 Cleanouts with a gas tight door shall beprovided at the base of all CHIMNEYS . [ ] 27-859 Chimney heights and locations. -(a) Low temperature CHIMNEYS . -Low temperaturechimneys shall extend at least three feet above the highestconstruction, such as a roof ridge, parapet wall, or penthouse,within ten feet of the chimney outlet, whether the constructionrevision: July 1, 2008 Title 27 / SUBCHAPTER 15323is on the same building as the chimney or on anotherbuilding. However, such constructions do not include otherchimneys, VENTS , or open structural framing. Any chimneylocated beyond ten feet from such construction, but not morethan the distance determined in subdivision (d) of this section,shall be at least as high as the construction.(b) Medium temperature CHIMNEYS . -Medium temperaturechimneys shall extend at least ten feet above the highestconstruction, such as a roof ridge, or parapet wall orpenthouse within twenty feet of the chimney outlet, whetherthe construction is on the same building as the chimney or onanother building.

10 However, such constructions do not includeother CHIMNEYS , and VENTS . Any chimney located beyondtwenty feet from such constructions but not more than thedistance determined in subdivision (d) of this section, shall beat least as high as the construction.(c) High temperature CHIMNEYS . -High temperaturechimneys shall extend at least twenty feet above the highestconstruction, such as roof ridge, parapet wall, penthouse,or other obstruction within fifty feet of the chimney outlet,whether the construction is on the same building as thechimney or in another building. However, such constructionsdo not include other CHIMNEYS , VENTS , or open structuralframing. Any chimney located beyond fifty feet from suchconstruction but not more than the distance determined insubdivision (d) of this section, shall be at least as high asthe construction.(d) Formula. -The following formula shall be used fordetermining the distances referred to in subdivisions (a),(b) and (c) of this section:D = F Awhere:D = Distance, in ft.
