2 - Invitation to Register and Participate in Sugar Transportation Work of corporation ** The kerala State civil supplies corporation Ltd (hereinafter called The corporation ) is the wholesale nominee of the Government of kerala for Sugar for the Public Distribution System. In this capacity it has to arrange to lift around 4000 tones of Levy Sugar every month from the Sugar Mills within the validity period of the quota and arrange its transportation to 56 depots in all the District/Taluk Head Quarters. The Mills and quantity to be transported may change from month to month. The corporation also purchases free sale Sugar, Pulses & Spices by contract, where again lifting in some cases has to be arranged within the period of the allotment and transported to the corporation Depots in kerala .

3 The corporation invites applications from Transport Contractors for registering with the corporation for transportation of Levy Sugar from various Sugar Mills in South India to the corporation s Depots. The registration shall be as per the terms in Part I. The persons/Firms who are involved in any criminal cases will not be considered for empanelment by the corporation . The corporation thereafter proposes to award contracts every month after taking quotes from registered contractors from the required Mills to the corporation s Depots. Quotes from only Transport Contractors already registered with the corporation will be considered.

4 The tender shall be as per the terms in Part II. PART I TERMS OF REGISTRATION 1. Scope of Work: The Transport Contractor should take delivery of the stock from the sugar Mill against within the validity period of the quota. The contractor is responsible for delivery of the stock of Sugar so lifted from Sugar Mills to the corporation s depots as specified in the work orders/Work Contracts. 2. Constitution of the Panel: The validity of the contract will be up to The corporation may induct Transporting Contractors that fulfill its eligibility criteria to the panel at later dates also up to The panel will be renewed after 31/03/2013 after collecting such details as the corporation may deem fit and after evaluating the data.

5 Transport Contractors should apply for registration giving full and true particulars required in Annexure attached hereto. Transport Contractors shall furnish a certificate from their Bankers, along with photograph as per Annexure Registration of a Transport Contractor does not entitle him to a minimum quantum of work. Along with registration an EMD of ,00,000/- will be deposited. The decision of the Managing Director/Manager (Levy Sugar) in awarding the work will be final and binding on the contractor. Sugar dealers and their associates are barred from this panel. 3. Eligibility: Only Transport Contractors having the following qualifications shall be considered for registration.

6 A minimum experience of three year in the field. The persons/Firms who are involved in any criminal cases will not be considered for empanelment by the corporation . 4. Application for Registration : Those who possess the eligibility criteria shall apply for registration in the form prescribed in Annexure-II Person(s) signing the application for registration shall state in what capacity he/they/is/are signing the contract, for example, as a proprietor of a firm, or as a Secretary/Managing Director etc of a limited Company or as a partner in the case of Partnership firm. Authorization letter for signing the application for registration should be signed by all the partners in the case of Partnership firm, and by the person who by his signature can bind his company as per the Board resolution in the case of limited company.

7 In the case of proprietary concern only the proprietor should sign the application for registration. The constitution of the firm shall not be changed during the period of the registration without prior notice to the corporation . In the case of Partnership firms, only firms registered with the Registrar of Firms shall be considered for registration. The person signing the contract in the case of partnership firms should have duly constituted authority to bind all the partners in all matters pertaining to the contract. An attested copy of the registered partnership deed should be furnished along with the contract. In the case of limited company the names of the Directors shall be mentioned and it shall be certified that the person signing the contract is empowered to do so on behalf of the Company.

8 A copy of the Memorandum and Articles of Association of the Company shall be attached with the contract. The Directors of a limited Company shall also furnish personal guarantee for fulfilling the contract. Both these conditions are applicable to only Transport Contractors without IBA approval. In the absence of evidence to the contrary, it will be presumed that the person signing the application and documents, thereafter has got the power and authority to sign and that such execution shall be binding on the firm or company, as the case may be. 5. Bank Guarantee: Applications for registration will have to be accompanied by a Bank Guarantee drawn on any scheduled Bank that shall be valid up to 31/03/2014.

9 The Bank Guarantee should be in the proforma prescribed by the corporation . The Bank Guarantee shall be retained in the corporation till 31/03/2013 or until such time that the contract awarded under this registration have been fulfilled or until the Transport Contractor leaves the panel after settling all dues. The amount of Bank Guarantee shall be lakhs. In the case of transport contractors approved by IBA and have owned 2 or 3 heavy vehicles, the Bank Guarantee shall be lakhs. Security Deposit (SD) 5% of the value of the contract, should be remitted as Security Deposit within 5 days of receipt of the Work Contract/Work Order.

10 The Security Deposit will be accepted for the next 5 days from the last date of submission of Security Deposit with penalty of ,000/- per day. Any Transport Contractor fails to submit Security Deposit within the period specified as above will not be allowed to participate in the next tender. Solvency Certificate - The transport contractor, whether it is a proprietary concern or a partnership firm or a limited company, should submit a solvency certificate for a total value of 5 lakhs with notarized undertaking not to alienate property during the period when registration is valid. Contractors who have IBA approval should undertake to have this approval throughout the validity period of the registration and in case the IBA approval of the Contractor is withdrawn at any time it should be intimated by the contractor and the Registration should be got renewed.
