DEPLOYMENT OF NEXT GENERATION 9 1 1. 5(a) APPROPRIATION. 6(1) IN GENERAL. 2 14(2) ADMINISTRATIVE EXPENSES. In addition 15to amounts otherwise available, there is appropriated 16to the Assistant Secretary for fiscal year 2022, out 17of any money in the Treasury not otherwise appro-18priated, $20,000,000, to remain available until Sep-19tember 30, 2030, to administer this section. 20(b) USE OFFUNDS. An eligible entity may use 21grant funds received under this section for 222 AEG21C68 CSC (1) costs associated with planning, implementa-1tion, and development activities, including such ac-2tivities related to the grant application; 3(2) deployment, operation, and maintenance of 4interoperable and reliable Next Generation 9 1 1, 5including ensuring the cybersecurity of Next Genera-6tion 9 1 1; and 7(3) training of personnel related to Next Gen-8eration 9 1 1.

3 9(c) CLAWBACK. The Assistant Secretary shall re-10cover some or all of the grant funds made available to 11an eligible entity under this section if 12(1) the eligible entity uses the funds for any 13other purpose than those set forth in subsection (b); 14(2) the eligible entity fails to establish a fund-15ing mechanism for Next Generation 9 1 1 sufficient 16to cover operations, maintenance, and upgrade costs 17within 3 years of the establishment of the grant pro-18gram.

4 19(3) the eligible entity engages in the diversion 20of any 9 1 1 fee or charge imposed by the eligible 21entity; or 22(4) the eligible entity uses funds to purchase, 23rent, lease, or otherwise obtain covered communica-24tions equipment or services (as defined in section 9 253 AEG21C68 CSC of the Secure and Trusted Communications Net-1works Act of 2019 (47 1608)). 2 SEC. 80102. ESTABLISHMENT OF NEXT GENERATION 9 1 1 3 CYBERSECURITY CENTER. 4In addition to amounts otherwise available, there is 5appropriated to the National Telecommunications and In-6formation Administration for fiscal year 2022, out of any 7money in the Treasury not otherwise appropriated, 8$9,000,000, to remain available until September 30, 2030, 9for the establishment of a Next Generation 9 1 1 Cyber-10security Center to coordinate with State, local, and re-11gional governments on the sharing of cybersecurity infor-12mation about.

5 The analysis of cybersecurity threats to, and 13strategies to detect and prevent cybersecurity intrusions 14relating to, Next Generation 9 1 1. 15 SEC. 80103. PUBLIC SAFETY NEXT GENERATION 9 1 1 ADVI-16 SORY BOARD. 17In addition to amounts otherwise available, there is 18appropriated to the National Telecommunications and In-19formation Administration for fiscal year 2022, out of any 20money in the Treasury not otherwise appropriated, 21$1,000,000, to remain available until September 30, 2030, 22to establish a Public Safety Next Generation 9 1 1 Advi-23sory Board, consisting of public safety officials and 9 1 241 professionals.

6 To provide recommendations to the Assist-254 AEG21C68 CSC ant Secretary with respect to carrying out the duties and 1responsibilities of the Assistant Secretary related to Next 2 Generation 9 1 1, including with respect to the grant pro-3gram established under section 80101. 4 SEC. 80104. DEFINITIONS. 5In this subtitle: 6(1) 9 1 1 FEE OR CHARGE. The term 9 1 71 fee or charge has the meaning given the term in 8section 6(f)(3)(D) of the Wireless Communications 9and Public Safety Act of 1999 (47 615a 101(f)(3)(D)).

7 11(2) ASSISTANT SECRETARY. The term Assist-12ant Secretary means the Assistant Secretary of 13 Commerce for Communications and Information. 14(3) COMMONLY ACCEPTED STANDARDS. The 15term commonly accepted standards means the 16technical standards followed by the communications 17industry for network, device, and Internet Protocol 18connectivity that 19(A) ensure interoperability by enabling 20emergency communications centers to receive, 21process, and analyze all types of 9 1 1 requests 22for emergency assistance (including multimedia 23and data)

8 And share such requests with other 24emergency communications centers and emer-255 AEG21C68 CSC gency response providers without the need for 1proprietary interfaces and regardless of juris-2diction, equipment, device, software, service 3provider, or any other factor; and 4(B) are developed and approved by a 5standards development organization that is ac-6credited by a United States or international 7standards body through a process 8(i) that is consensus-based and open 9for participation, provides conflict resolu-10tion, and invites comment; and 11(ii) through which standards are made 12publicly available once approved.

9 13(4) ELIGIBLE ENTITY. The term eligible enti-14ty means a State or a Tribal organization that 15has 16(A) named a single point of contact to co-17ordinate the implementation of Next Generation 189 1 1; and 19(B) developed and submitted a plan for the 20coordination and implementation of Next Gen-21eration 9 1 1 consistent with any requirements 22of the Assistant Secretary. 236 AEG21C68 CSC (5) NEXTGENERATION9 1 1. The term 1 Next Generation 9 1 1 means an interoperable, 2secure, Internet Protocol-based system that 3(A) employs commonly accepted standards; 4(B) enables emergency communications 5centers to receive, process, and analyze all types 6of 9 1 1 requests for emergency assistance; 7(C) acquires and integrates additional in-8formation useful to handling 9 1 1 requests for 9emergency assistance.

10 10(D) supports sharing information related 11to 9 1 1 requests for emergency assistance 12among emergency communications centers and 13emergency response providers without the need 14for proprietary interfaces and regardless of ju-15risdiction, equipment, device, software, service 16provider, or any other factor; and 17(E) ensures reliability by enabling ongoing 18operation, including through the use of geo-di-19verse device and network agnostic elements that 20provide more than 1 physical route between end 21points with no common points where a single 22failure at that point would cause the operation 23of Next Generation 9 1 1 to fail.
