1 Automatic Exchange of Financial Account Information and Foreign Account Tax Compliance Act CTBC Bank Co., Ltd. (the Bank ) has registered as a participating financial institution under Foreign Account Tax Compliance Act ( FATCA ) and adopted the Common Reporting Standard ( CRS ). In compliance with FACTA and the Inland Revenue (Amendment) (No. 3) Ordinance, we would like to inform you that our FATCA and CRS Compliance Policy for existing customers. FATCA CRS FATCA 3 FATCA CRS With regard to the pre-existing accounts holders ( accounts set up before 1 January 2017), the Bank is required to identify your Specified Persons or other tax residence status through obtaining your self-certification statement, documentary evidence or Relationship Manager inquiry.
2 If you fail to provide us sufficient FATCA and CRS documents for identify your status, or you disagree that we report your account to the Inland Revenue Services when you have been identified as a Specified person , we will consider you as a recalcitrant account and take corresponding measures. If the required personal information is not provided, the Bank will treat your status as a tax resident of each jurisdiction for which an indicium is identified and report your information to the hong kong Inland Revenue Department ( IRD ) as required by the relevant CRS guidelines.
3 For the case that hong kong is your only tax residence, your financial account information will not be reported to the IRD. ( 2017 1 1 ) FATCA CRS CRS In consideration of your rights and interest, please complete the FATCA and CRS Self-Certification correctly. We will identify your status based on the form or documents you provided.

5 The Common Reporting Standard ( CRS ) released by the Organisation of Economic Co-operation and Development ( OECD ) aims to put in place a global model of automatic exchange of financial account information in tax matters ( AEOI ) to combat tax evasion and protect the integrity of taxation systems. Over 100 jurisdictions, including hong kong , have publicly expressed commitment to its implementation ( Participating Jurisdictions ). Under the CRS, a financial institutions ( FI ) of a Participating Jurisdiction is required to carry out due diligence procedures to identify the jurisdiction of residence of an account holder and identify whether a financial account is a Reportable Account 1.
6 In respect of a Reportable Account, an FI will need to report relevant information to the local tax authorities, who then exchange the relevant information with the tax authorities of the Reportable Jurisdictions2 where account holders are tax residents. 2. CRS CRS ( ) What do FIs have to do to comply with CRS? CRS requires FIs to review and collect information that will enable them to identify Reportable Accounts and report the relevant personal and financial data of the Reportable Accounts to the local authority ( IRD) on an annual basis.

8 Under CRS, FIs will be liable for reporting on Reportable Accounts, , financial accounts held by individuals or entities that are tax residents in jurisdictions that have signed AEOI agreements with hong kong . hong kong taxpayers who are not tax residents of any territory outside hong kong will not be reported. The Amendment Ordinance requires FIs to apply due diligence procedures to collect all required information and documentation from account holders. To identify Reportable Accounts, FIs may ask account holders to complete self-certification forms for identification of their tax residency status.
9 4. CRS CRS ( ) ( ) ( ) CRS CRS Which types of customers are affected by CRS due diligence and reporting? Customers that hold financial accounts in FIs will be subject to CRS required due diligence procedures. Customers affected include individuals (whether banking directly or indirectly through an entity) and entities such as corporations, partnerships and trusts, etc. Customers that are identified as reportable persons, tax residents of jurisdictions that have signed AEOI agreements with hong kong , will be subject to CRS required reporting.
10 Therefore, customers whose jurisdiction of tax residence is hong kong only are not subject to reporting for CRS purposes. 5. In accordance with the due diligence procedures prescribed by the Amendment Ordinance (which are required by international standards), for accounts opened on or after 1 January 2017, reporting financial institutions should request a self-certification from the account holder.
