5 (1-1) "Active life"ofa facility means theperiodfrom the initial re-ceiptofhazardouswaste at the facility until theSecretaryreceivescerti-ficationoffina l closure.(2) "Active portion" means thatportionofa facilitywheretreat-ment,storage,or disposaloperationsarebeingor havebeenconductedaftertheeffectivedate of thissubtitleandwhichis not aclosedportion.(2-1)"Ancillaryequipment" meansa deviceincluding,but not lim-ited to, such devices as piping, fittings, flanges, valves, andpumps,thatis used to distribute, meter, orcontrolthe flowofhazardouswastefromitspointofgenera tionto astorageortreatmenttank or tanks,betweenhazardouswaste storage andtreatmenttanks to apointofdisposalonsite, or to a pointofshipmentfordisposaloffsite.(3)"Aq uifer"means ageologicformation, groupofformations,orpartofa formation capableofyieldinga significantamountofgroundwaterto wells or springs.

6 (4)"Authorizedrepresentative"means thepersonresponsiblefortheoveralloperati onofa facility or anoperationalunit (that is, partofafacility);for example, theplantmanager,superintendent,orpersono fequivalentresponsibility.(4-1) "Battery" means:(a) A deviceconsistingof one or moreelectricallyconnectedelectrochemical cells which isdesignedto receive, store, anddeliverelectricenergy; or(b) An intact,unbrokendevice which wouldotherwisemeet thedefinitionofbattery in B(4-1)(a)ofthisregulationfromwhichthe elec-trolytehas been removed.(5) "Boiler" means anencloseddevice usingcontrolledflame com-bustionand having oneofthefollowing characteristics:(a) The unit satisfies allofthefollowingcriteria:849 Supp. (,--(i)Theunit shall havephysicalprovisionsforrecoveringandex portingthermalenergy in the formofsteam,heatedfluids, orheatedgases.)

7 (ii)Theunit'scombustionchamberandprimary energyrecov-erysectionorsectionsshall beofintegraldesign. To beofintegralde-sign, thecombustionchamberand theprimaryenergyrecoverysectionorsection s,suchaswaterwallsandsuperheaters,shall bephysicallyformedinto onemanufacturedorassembledunit. A unit inwhichthecombustionchamberand theprimaryenergyrecoverysectionorsection sarejoinedonlyby ducts orconnectionscarryingflue gas ,secondaryenergyrecoveryequipmentsuch aseconomizersorairpreheatersneednotbephy sicallyformedintothesameunitas thecombustionchamberand units thattransferenergydirectlyto aprocessstreamandfluidizedbedcombustionu nits arenotprecludedfrombeingboilerssolelybec ausethey arenotofintegraldesign.(iii)Whileinopera tion,the unit shallmaintaina thermalen-ergyrecoveryefficiencyofatleas t60percent,calculatedintermsoftherecover edenergycomparedwiththethermalvalueofthe fuel.

8 (iv)Theunit shallexportandutilizeatleast75percentoft herecoveredenergy,calculatedon an annual basis. In thiscalculation,creditmay not be given forrecoveredheat usedinternallyin are thepreheatingoffuel orcombustionair,andthedrivingofinducedor forceddraftfans orfeedwater pumps.(b) TheUnitis onewhichtheSecretaryhasdetermined,on acase-by-casebasis, to be aboiler,afterconsideringthestandardsinRe gula-tion .04 Fofthischapter.(6)"Closedportion"means thatportionofa facilitywhichanowneroroperatorhasclosedi naccordancewiththeapprovedfacilityclosur eplanand allapplicableclosurerequirements.(See also"activeportion"and"inactiveportion". )(6-1)"Component"meanseitherthetankoranc illaryequipmentofa tanksystem.(7)"Confinedaquifer"meansan aquifer:(a)Boundedaboveandbelowbyimperme ablebedsor bybedsofdistinctlylowerpermeabilitythan thatoftheaquiferitself;(b) (7-1) "Consignee" means the ultimate treatment, storage, or disposalfacility in a receiving country to which a hazardous waste will be sent.

9 (8) "Constituent" or "hazardous waste constituent" means a con-stituentwhich caused the Secretary to list the hazardous waste in aconstituentlisted (9) "Container" means anyportabledevice inwhicha material isstored, transported, treated, disposed of, or otherwise handled.(10)"Contingencyplan" means a documentsettingout an organ-ized, planned, andcoordinatedcourseofaction to be followed in caseofa fire, explosion, or releaseofhazardous waste orhazardouswaste con-stituentswhich could threaten human health or theenvironment.(10-1) "Controlled hazardous substance" means ahazardouswasteas defined in COMAR , except (10-2) "Corrosion expert" means an individual who is:(a) Qualified to engage in the practiceofcorrosioncontrol on bur-ied or submerged metalpipingsystems and metal tanksbyreasonofthatindividual's knowledgeofthe physical sciences and theprinciplesofen-gineeringand mathematics, acquired by aprofessionaleducationandrelatedpractica l experience; and(b) Certified as being qualified by the NationalAssociationofCorrosion Engineers (NACE), or who is a registeredprofessionalengi-neer who has certification or licensing that includeseducationand ex-periencein corrosion control on buried or submerged metalpipingsys-tems and metal tanks.

10 (11) "Department" means theDepartmentoftheEnvironment.(12) "Designated facility" means a hazardous wastetreatment,stor-age, disposal, or recycling facility which has beendesignatedon themanifest by the generator under COMAR and:(a) Has received a permit or interim status inaccordancewith therequirementsofCOMAR ,or40 CFR 270 and 124;(b) Is located in a state authorized inaccordancewith 40 CFR 271which:(i) Has received a permit or interim status, or851 Supp. (ii)Is allowed by the state to accept the waste that is beingshipped,ifthe state has not yet obtained authorization to regulate thatparticularwaste as hazardous;(c) Has received a permit or interim status from a state authorizedin accordance with 40 CFR271:or(d) Is regulated under COMAR (2), ,40 CFR (c)(2), 40 CFR Part 266, Subpart F, oranalogous authorities in other states.
