1 1 Mobil Oil Australia Pty Ltd ,Viva Energy Aviation Pty Ltd, Caltex Australia Petroleum Pty Ltd, BP Australia Pty Ltd (together the Infrastructure Provider) Enquiry Form for Applicant seeking Access Services at the Melbourne Tullamarine Airport Fuel Facilities Introduction 1. Mobil Oil Australia Pty Limited ABN 88 004 052 984, Caltex Australia Petroleum Pty Limited ABN 17 000 032 128, BP Australia Pty Ltd ABN 53 004 085 616, Viva Energy Aviation Pty Limited ABN 29 167 761 453 as Infrastructure Provider own and operate the Fuel Facilities at Melbourne Airport. 2. The Infrastructure Provider supplies Access Services at the Fuel Facilities to Applicants who meet the Qualifying Criteria and who enter into a User Agreement. 3. Access Services are services relating to the use of or access to the Fuel Facilities including services relating to the scheduling, receipt, handling, measuring, storage, supply, distribution or withdrawal of Jet Fuel to, in, through or from any part of the Fuel Facilities that facilitate the sale of Jet Fuel to Customers at Melbourne Airport.

2 4. This website sets out the process for Applicants seeking Access Services. 5. If Applicant has a dispute arising from the process the Applicant shall give notice in accordance with the Disputes Regime. 6. The definitions and rules of interpretation set out in the User Rules apply to this document, unless the context requires otherwise. Enqui ry 7. The Enquiry Form must be printed, signed and dated by the Applicant, and sent to the Melbourne JUHI Manager at the following address: Melbourne JUHI Manager 3-27 Marker Rd | Melbourne Airport | VIC 3045 PO Box 1095, Tullamarine VIC 3043 8. Once the completed Enquiry Form has been received by the Operator and it has been verified to the satisfaction of the Operator that the Applicant is a genuine applicant and not subject to international trade sanctions, the Operator will forward a Confidentiality Agreement electronically for the benefit of the Infrastructure Provider, to be signed by the Applicant and returned to the Operator.

3 9. On receipt of the Confidentiality Agreement signed by the Applicant, the Operator will provide the Applicant with access to the Website for the following: a. Application Form b. Qualifying Criteria including assessment basis for meeting Qualifying Criteria c. User Agreement, User Rules and Operating Principles d. Aircraft Refueling Indemnification Agreement 2 Mobil Oil Australia Pty Ltd ,Viva Energy Aviation Pty Ltd, Caltex Australia Petroleum Pty Ltd, BP Australia Pty Ltd (together the Infrastructure Provider) e. Core Principles f. Disputes Regime g. Reference Tariffs current h. User Application fee of AU$20,000* (*If Applicant accepted, and incurs tariff charges within 12 months of successful application, then the User Application fee will be offset against Applicant s monthly tariff charges). 10. Once the above documents have been reviewed by the Applicant, and the decision made by the Applicant to proceed with the application, then the Applicant shall submit the Application Form in writing and User Application Fee (bank details to be provided at the time) to the Infrastructure Provider providing necessary details to satisfy the Infrastructure Provider that the Applicant meets the Qualifying Criteria.

The Application Form and associated documentation (current at time of application) must be completed, signed and dated by the Applicant, and together with the User Application Fee sent to the Melbourne JUHI Manager at the following address: Melbourne JUHI Manager 3-27 Marker Rd | Melbourne Airport | VIC 3045 PO Box 1095, Tullamarine VIC 3043 12. The Infrastructure Provider will as far as reasonably possible retain all information provided to it by an Applicant as confidential (unless that information is already publicly available) and use it only for the purposes of the Application and the supply of the Access Services, unless that information is already publicly available but subject to any requirement to disclose some or all of the information by law or by order of any judicial authority. For the purposes of this clause the Infrastructure Provider will include its employees, related companies and contractors who provide services associated with the application process and the Access Services.
