6 (1)Evidencetherewasanevaluationoftheappr opriatenessofthechild seducationalsettingwhileinplacementandof thesetting sproximitytotheeducationalsettinginwhich thechildwasenrolledatthetimeofplacement. (2)Anassuranceeitherthatthedepartmentcoo rdinatedwithappropriatelocaleducationala genciestoidentifyhowthechildcouldremaini ntheeducationalsettinginwhichthechildwas enrolledatthetimeofplacementor,ifitwasde termineditwasnotinthechild sbestinteresttoremaininthatsetting,thatt heaffectededucationalagencieswouldimmedi atelyandappropriatelyenrollthechildinano thereducationalsettingduringthechild splacementandensurethatthechild , localeducationalagencies meansthesameasdefinedinthefederalElement aryandSecondaryEducationActof1965, 9101, 7801(26).

8 Andtakenasawhole,lacksseriousliterary,sc ientific,political, ,guardian, ,guardian,orothercustodianforgoodcausede sirestoberelievedofthechild sparentsrelievedofthechild ,guardian, sorguardian smentalcapacityorcondition,imprisonment, sparent,guardian, ,guardian,custodian,orotheradultmemberof thehouseholdinwhichachildresidesdoesanyo fthefollowing:unlawfullyuses,possesses,m anufactures,cultivates,ordistributesadan geroussubstanceinthepresenceofachild;ork nowinglyallowssuchuse,possession,manufac ture,cultivation,ordistributionbyanother personinthepresenceofachild;possessesapr oductwiththeintenttousetheproductasaprec ursororanintermediarytoadangeroussubstan ceinthepresenceofachild;orunlawfullyuses ,possesses,manufactures,cultivates,ordis tributesadangeroussubstancespecifiedinsu bparagraph(2),subparagraphdivision(a),(b ),or(c),inachild shome,onthepremises,orinamotorvehicleloc atedonthepremises.
