1.05 Application of ERISA. The Medical FSA portion of the Plan is an “employee welfare benefit plan” within the meaning of section 3(1) of ERISA. Certain requirements of ERISA, including the fiduciary responsibility provisions, apply to the Medical FSA, as referenced in ARTICLES X and XI of this Plan document.
