2 B)Cloudseeding toinducerainfall -PhilippineAtmosphericGeophy-sical&Astro nomicalServiceAdministration(PAGASA);c)R echarginggroundwatersupplies theCouncilmay exercise any of following may file an application with the Council for permit/authority:a) Citizens of the PHILIPPINES ;b) Associations, duly registered cooperatives or corporations organizedunder the lawsofthePhilippines, at least 60 percent of the capital ofwhich is owned by the citizens of the PHILIPPINES ;c)Governmententities and instrumentalities, including government-owned and controlled for those on cloudseeding, any application for permit/authority in Section 1 shall befiledwiththe Office of the Public Works District Engineer, the NIA Provincial lrriga-tion Engineer, NPC Regional Managers or the LWUA WATER DistrictGeneral Manager whichever is designated as agent by the Council in the pro-vince where the point of diversion is situated inthecase of appropriation ofwaters or where the project is located in all other applicationsshall befiledin the prescribed form, sworn to by the applicant and supportedby thefollowing:A.

3 For a WATER Permit for Agricultural Purposes document ofownership/possessionof the land to be developedsuch as:a)Certificate of Title;b)Tax Declaration;c)Certificate of Land Transfer: ord)Contractoflease,if applicant is Plan of Area showing:a)Point of Diversion determined graphically by its latitudeand longitude;b)Delineation of area indicating hectarage for which waterwill be used and adjoining lands and their correspondingowners duly indicated relative to the point of ;c)Nature of diversion works. whether temporary or perma-nent; manner of appropriation, whether by gravity pump;kind of crop; and approximate location or conveyancecanal orcondurt:andd)In case of appropriation of ground WATER , location andspacing of proposed drilling sites, kind of crop, and ap-proximate location or conveyance canal or conduit in lieuof items\a)and(c) In-dustrial Purposes, or for aPermittoDumpMine Tailings or andconceptualplans onconvenientscale showing thesource of WATER , layout of proposed works, and point of diversiondetermined graphically by itslatitudeand longitude.

4 Description of project, includingamongothers, howwaterwillbeused,amountof WATER needed for the purpose, power expected tobegenerated ifapplicable,amountof WATER tobedischarged back tothe source and measures tobetaken to insurethatsuch waters arenot polluted,otherrelevantinformation; ofIncorporationor Articles ofPartnershipin caseapplicantis a privatecorporationorpartnership,or certificate of registration incase of cooperatives; application is forindustrialuse of ground WATER , the loca-tion and spacing of drilling well sites instead of diversion point shouldbeindicated in the location WaterPermitforMunicipalPurposes showing the relative positionof source area tobesupplied, and diversion point determined graphic-ally by its latitude and longitude; description of the project, includingnatureandamountofwater tobeused,populationand area tobeserved, andotherperti-nent facts andinformation; ofIncorporationor Articles ofPartnershipin case applicantis a privatecorporationorPartnership,or Certificate of Registrationin case of cooperatives; the application involves the use ofgroundwater,the locationand spacing of drilling well sitesdeterminedgraphically by latitudeandlongitude shouldbeindicated in the location plan.

8 The Officeconcernedshallprocess the same todeterminecompliancewith therequirementsprescribed inSection 4 hereof. It found in order,anduponpaymentof the filing fee, noticesof theapplicationshall be posted in aconspicuousplace in said office and shallremain posted for a period of Sixty (60) ofapplicationshall, like-wise, be sent by the said office to the following for posting in aconspicuousplace forth-same )BarangayChairmanof the place where the point ofdiversionislocated:b) MunicipalSecretaryof the town where the point of diversion islocated;27c)TheSecretaryof theSangguniangPanlalawiganof the provice wherethepointofdiversionis located;d)Public WorksDistrictEngineerorProvincialIrrigat ionEngineerasthe case may of the notice ofapplicationshall, likewise, befurnishedto con-cernedRegional Offices of theMinistryofPublicWorks,NationalIrrigat ionAdministration,NationalPowerCorporati onand Ministry ofNaturalResourcesandLocalWaterDistrictO ffice, if (7)days from the first day of posting of notice at theoffice where he'applicationis filed, the officeconcernedshall deter-mine:I)Theapproximateseasonaldisch arge of thewatersource;2)Theamountofwateralready appropriatedfor beneficial use;3)Thewaterrequirementof use prescribed by theCouncil;4)Possibleadverseeffects onexistinggrantees/permitteesorpublic/pr ivateinterest;5)Environmentaleffects;6)L and-useeconomics.

9 7)Whethertheareatobeirrigatedcan beintegratedwiththatofanexistingorpropos edirrigationassociationforcommonir-rigat ion facilities and8) who may be adversely af-fected by the proposedappropriationmay file a verifiedprotestwiththeCouncilorwith anydeputizedagencyinvestigatingthe applica-tion within sixty (60) daysafterpostingof the Notice ofApplicationin the office where theapplicationwas anapplicationforwaterpermit shall begovernedbythe rules prescribed for (30) days from the first day ofpostingof notice, the Officeinvestigatingtheapplicationshalltr ansmitthe sametogetherwith all the records, findings of facts anditscommentsandrecommendations,as well as those ofothergovern-ment agencies, if any, to theCouncilfor cases ofapplicationforirrigation,thereportshal l alsobecoursedthrutheRegionalIrrigationDi rectorwhoshalltransmitthe same to cases ofapplicationsforhydraulicpower, thePublicWorksRegionalDirectorshalltrans mittheapplication,thrutheCentralOffice of theNationalPower Corporation,Manila,whichshallforwardthe same to theCouncilwithitscommentsandrecommendati onswithinthirty(30)

10 Days Drill-Theapplicationtoappropriategroundw atershallbe processed foradherencetorequirementsandshallbeinve stigatedin thefieldtodetermineanyadverseeffectto public therequirementsand has beenfoundnotprejudicialto public orprivateinterestit shallbetransmitted,following therequirementsofSection9 hereof, to theRegionalDirec-tor of theMinistryofPublicWorkswhois herebyauthorizedto issuethepermitto drillwhichshallbesubjectto the followingconditions:I)Drillingoperations shallbeinaccordancewith the rulesprovidedherein;2) The rate ofwaterwithdrawalto beapprovedshallbedeterminedafterpumpingt ests and shall in no case exceed the ratestatedin theapplication;3) A permit to drill shallremainvalid for six (6)months,unless a longerperiod is allowed by theCouncilforreasonablegrounds;and4) The permit to drill shall be regarded as atemporarypermit, rate of DrillingOperations-Areporton the result of the drillingoperationsshall besubmittedto theinvestigatingofficewithinthe6-monthpe riodstatedin the preceding.
