3 transportation and erection ofPrecast Concrete, under section 20 of the Health and Safety inEmployment Act a code is Approved , a Court may have regard to it in relation tocompliance with the relevant sections of the Health and Safety inEmployment Act 1992. This means that if an employer in an industry orusing a process to which an Approved code applies can show compliancewith that code in all matters it covers, a Court may consider this to becompliance with the provisions of the Act to which the code Margaret WilsonMinister of LabourSAFE Handling , transportation AND erection OF PRECAST CONCRETE 7 SUMMARY OF THEHEALTH AND SAFETY INEMPLOYMENT ACT 1992 The principal object of the Health and Safety in Employment Act 1992(HSE Act) is to prevent harm to employees at work.

4 To do this, itimposes duties on employers, employees, principals and others, andpromotes excellent health and safety management by employers. It alsoprovides for the making of regulations and codes of CODES OF PRACTICEThe HSE Act provides for the development and approval of statements ofpreferred work Practice or arrangements that may be Approved as Approved codes of Practice . These are recommended means ofcompliance with provisions of the Act, and may include procedures whichcould be taken into account when deciding on the practicable steps to betaken. Compliance with codes of Practice is not mandatory. However,they may be used as evidence of good Practice in DUTIESE mployers have the most duties to ensure the health and safety have a general duty to take all practicable steps to ensure thesafety of employees while at work.

5 (This is set out in section 6.) Inparticular, they are required to take all practicable steps to: Provide and maintain a safe working environment; Provide and maintain facilities for the safety and health ofemployees at work; Ensure that machinery and equipment is designed, made, set up,and maintained to be safe for employees; Ensure that employees are not exposed to hazards in the course oftheir work; and Provide procedures to deal with emergencies that may arise whileemployees are at safe Handling , transportation AND erection OF PRECAST CONCRETEHAZARD MANAGEMENTE mployers shall have an effective method to identify hazards in the placeof work (previously existing, new and potential) and regularly reviewthem to determine whether they are significant hazards and requirefurther action.

6 Where there occurs any accident or harm in respect ofwhich an employer is required to record particulars, the Act, section 7(2),requires the employers to take all practicable steps to ensure that theoccurrence is so investigated as to determine whether it was caused by orarose from a significant hazard. Significant hazard means a hazard that is an actual or potential cause orsource of: Serious harm; or Harm (being more than trivial) where the severity of effects onany person depend (entirely or among other things) on the extentor frequency of the person s exposure to the hazard; or Harm that does not usually occur, or usually is not easilydetectable, until a significant time after exposure to the the hazard is significant, the HSE Act sets out the steps employersmust take: Where practicable, the hazard must be eliminated.

7 If elimination is not practicable, the hazard must be isolated. If it is impracticable to eliminate or isolate the hazard completely,then the employer must minimise the hazard to addition, the employer must, where appropriate: Ensure that protective clothing and equipment is provided,accessible and used; Monitor employees exposure to the hazard; Seek consent of employees to monitor their health; and With informed consent, monitor employees FOR EMPLOYEESB efore employees begin work, they must be informed by their employerof: Emergency procedures; Hazards employees may be exposed to while at work; Hazards employees may create while at work which could harmother people; How to minimise the likelihood of these hazards becoming asource of harm to themselves and others; andSAFE Handling , transportation AND erection OF PRECAST CONCRETE 9 The location and correct use of safety are also required to inform employees of the results of anyhealth and safety monitoring.

8 In doing so, the privacy of individualemployees must be TO INVOLVE EMPLOYEES IN THEDEVELOPMENT OF HEALTH AND SAFETYPROCEDURESE mployers need to ensure that all employees have the opportunity to befully involved in the development of procedures for the purpose ofidentifying hazards and dealing with significant hazards, or dealing withor reacting to emergencies and imminent OF EMPLOYEESE mployers must ensure employees are either sufficiently experienced to dotheir work safely or are supervised by an experienced person. In addition,employees must be adequately trained in the safe use of equipment in theplace of work, including protective clothing and OF PEOPLE WHO ARE NOTEMPLOYEESE mployers are also responsible for the health and safety of people who arenot employees.

9 Employers must take all practicable steps to ensure thatemployees do not harm any other person while at work, includingmembers of the public or visitors to the place of DUTIESIf you are an employee, the Act gives you responsibility for your ownsafety and health while at work. You must also ensure that your actionsdo not harm anyone AND SERIOUS HARM (RECORDSAND NOTIFICATION)The Act defines: Accident means an event that:(a)Causes any person to be harmed; or(b) In different circumstances, might have caused any person to safe Handling , transportation AND erection OF PRECAST CONCRETEThis means that accident includes both near misses and accidents thatresult in harm to a person or might have caused any person to be employer is required to maintain a register of accidents and seriousharm; and record particulars relating to:(a)Every accident that harmed (or, as the case may be, might haveharmed) (i)Any employee at work.

10 Or(ii)Any person in a place of work controlled by the employer;and(b) Every occurrence of serious harm to an employee at work, or as aresult of any hazard to which the employee was exposed while atwork, in the employment of the there occurs any serious harm or accident an employer must:(a)As soon as possible after its occurrence, notify the nearest OSHoffice of the occurrence; and(b) Within 7 days of the occurrence, give the Secretary of Labourwritten notice, in the prescribed form, of the circumstances of notification to the Secretary applies to:(a)Every occurrence of serious harm to an employee at work, or theoccurrence of serious harm as a result of any hazard to which theemployee was exposed while at work, in the employment of theemployer; and(b) Accidents of a kind or description required by Handling , transportation AND erection OF PRECAST CONCRETE 11 PART 1.
